Justice IG sends criminal referral of Andrew McCabe to US attorney

The Justice Department's inspector general has sent a criminal referral regarding former FBI Deputy Director Andrew McCabe to the US attorney's office in Washington, according to a source familiar with the matter.

A McCabe spokesperson, the Justice Department and US attorney's office all declined to comment.

I'd like to see the referral to compare it to the IG report about McCabe. The report mentioned an improper leak, false statements to Comey, and three specific instances of perjury, while referring to the false statements and perjury as “lack of candor.” It then referred all of that to the FBI for its action, but did not specifically recommend criminal proceedings.

Instead of this being anything nefarious, I suspect, but don't know, that all of this may have something to do with some arcane, internal DOJ IG procedure. If someone here is more knowledgeable, please enlighten us.

LA Times: The referral to the D.C. U.S. attorney's office occurred some time ago, after the inspector general concluded McCabe had lied to investigators.

With what fighting an indictment like this (my guess is at least three separate well founded perjury counts) is likely to cost, that $568,000 will last about as long as an ice cube on a sunny day in the Saudi desert.

The sessions bashers here are so over the top, narrow minded, and repetitive, that I’ve sometimes lost interest in visiting FR. Perhaps that is on purpose hmm?

And there are lots more of those in the FBI, DOJ and CIA.

They’re going after McCabe because McCabe claimed he didn’t back down on the Clinton e-mails when the Department of Justice told him he had to. Don’t forget, the OIG is the Department of Justice.

“McCabe told the OIG that on August 12, 2016, he received a telephone call from PADAG regarding the FBI’s handling of the CF Investigation (the “PADAG call”). McCabe said that PADAG expressed concerns about FBI agents taking overt steps in the CF Investigation during the presidential campaign. According to McCabe, he pushed back, asking “are you telling me that I need to shut down a validly predicated investigation?” McCabe told us that the conversation was “very dramatic” and he never had a similar confrontation like the PADAG call with a high-level Department official in his entire FBI career.”

The PADAG here is the Justice Department official coordinating with the FBI about the investigation. Note that McCabe is claiming he interpreted the PADAG as ordering him to stand down in his investigation. He claims he refused. The compromise reached was that they had to keep it out of the news. But McCabe, by arguing that the FBI hadn’t shut down the investigation at the DoJ’s orders, confirmed that the investigation was taking place. For doing that, he is being criminally prosecuted.
