I wouldn’t worry that much about it, just yet. Judges may decide only the issue placed in front of them in the lawsuit. Anything they write beyond the scope of the facts before them is considered dicta: interesting but not binding. Nor is the judge’s words any real indication of the thoughts of fellow judges.
There weren’t very effective ways to rein it in. Beyond the occasional Andrew Jackson pbtttt.
It still seems to be time to take notice of the obiter dicta. Because that clues us in to where things may go, and it also often serves as source material in future.
And same with people in blackface?
Playing dressup does not change basic reality.
The role of a judge is to apply the law as it stands, not to make policy. Where is the statute that supports this ruling?

Slavery existed here for 179 years before there was a US government, it was a contentious issue since the foundation of the US government, which abolished the slave trade after only 20 years of its existence.
This is the stuff that revolutions are made of.

From the looks of it the judge has a conflict of interest.
