2nd Amendment defenders warn of 'star chamber' gun control

One of the nation’s best-known advocates for the Second Amendment is warning of a new push for “star chamber” courtroom proceedings in which a prosecutor and a judge could decide to withdraw constitutional rights from individuals merely because someone claims they are a danger.

Moves toward gun control have come up after almost every major mass shooting in recent years. But such “star chamber” plans have not been widespread.

Yet.

One reason is that there already are procedures to take guns away from someone who, given due process, is determined to be a danger to others.

But the advocacy group Gun Owners of America is warning the newest push is a danger.

Among the many reasons NOT to advertise your defenses.

No bumpers stickers, T-shirts, hats, etc.

In the DoD security world, the first thing they classify are their security measures for a given program or capability.

Same process could be used to churn out search warrants looking for “banned” AR-15s. Just a formality to allow kicking in your door in response to an anonymous tip from a recruited neighborhood stooge or your kids being brainwashed in school to rat on their parents. Tried and true police state tactics

i expect in the future they’ll be anonymous judges hidden by FISA type laws but severely loosened and then implemented politically.

Truth is that the Left really wants to rule by decree and to hell with the legislative and judicial process. They’ll institute block wardens to keep an eye on everyone and then go to this secret star chamber and express their “grave concerns”. Banana Republic stuff all the way.

We are already here, FISA warrants for political opponents, warrants for an attorney client's privileged records, restraining orders for domestic violence based on little more than a statement of an aggrieved spouse or partner, etc.

A terrible precedent to set. Sure, the disarmament types will defend these laws - "...friends/family/neighbors/police would have to convince a judge..." Sure.

One, there are no-doubt many judges out there who would accept virtually any evidence/claims and sign off on disarming someone.

Two, what happened to the principle of innocent until proven guilty? This looks more like assumed guilty until the victim goes through serious time and money to prove his or her innocence.

Three, these laws may look and sound reasonable (to some I guess, not me) but they are just the first step down the proverbial slippery slope. If this looks so good on a case by case basis - and you know the disarmament crowd will lie and distort facts to make it so. Then what's to stop them from expanding this to certain types or demographics? Sure, the left says they're against profiling - unless and until it works for them. So they'd start getting the go ahead to disarm entire classes of people. "Oh, anyone 'crazy' enough to want a 'high capacity' magazine must be a danger. Let's raid everyone's home who bought .223 or 5.56 ammo and confiscate their firearms..."

One Star Chamber begets other Star Chambers. Erase the ‘rules’ at your own peril. They don’t call it a gun show loophole for nothing.

Star Chamber was a creation of James 1st who wanted to circumvent the Magna Carta and Parliament in order to ensure that the Royal “justice” prevailed against his enemies. It’s just more administrative state BS that allows courts to avoid due process for defendants.

James’ successor Charles 1 continued the practice and rightly paid with his head after losing the English CW.

Admistration law has been a cornerstone of progressive thought ever since our first fascist president W. Wilson. Creeping administrative law is essentially equivalent to soft martial law. Read Hamberger’s books.
