Making false statements to federal investigators is a FELONY!! My God— that what is charged on Flynn. Why is that man not in chains?? WHERE IS THAT DAMNED SESSIONS?
Baloney. There is no storm coming, now or ever. The OIG is a paper tiger to hide another paper tiger - Jeff Sessions, whose too busy fighting marijuana use to care that the due process and equal protection are getting flushed down the toilet.
Nothing’s going to happen. The losers win, and the winners lose. Crime does pay, at least if you’re connected in the swamp
I think I’ve read that there will be one more report which will be bigger. It would seem to follow that the first one is a taste and the real meat will be in the second one but we do live in strange times.
According to former FBI officials, the obligation of bureau employeesagents or otherwiseto have candor in performance of their duties comes from the need for FBI officials to represent the federal government in legal proceedings, act as witnesses in trials, and manage informants. Under the FBIs standard, candor is not simply telling the truthit confers an obligation to disclose relevant information even if an investigator has not directly asked about it. The standards are strictone former FBI official estimated 20 to 30 bureau employees were dismissed annually for matters of candor. In one case described in a 2012 FBI report, an employee was dismissed after she lied to investigators about her husbands drug use; in another, an employee was fired after they misled investigators about properly disposing of evidence. Another agent lost his job after using his bureau car to transport his daughter to daycare, and then lied about it.If you have a candor violation, that is treated much more severely than other things that might be more serious, like a DUI, said Clint Watts, a former FBI agent and a fellow at the Foreign Policy Research Institute. You have to be able to back up your statements, and if you dont have good candor, you cant go jamming people up for lying to federal agents.
Candor cases can drag on for months, they said, in part because they can turn on a difference in perceptionwhether an employee understood the question, or answered to the best of their knowledge, or simply failed to recall somethingand often when someone is close to retirement, that person will simply be allowed to retire.
The key element of candor cases is that the standard is higher for FBI employees than for the typical government official. The bar for perjury for example, is extremely high and requires prosecutors to prove a defendants state of mind. Thats very difficult, which is why few public officials are ever prosecuted for iteven in criminal investigations, its typical to charge obstruction rather than perjury. But FBI officials cant simply avoid lying under oatheven omitting the truth could get them fired.
It sounds more akin to the honor code at the nation's military academies.
> Looks like the only penalty for McCabe is dismissal. Its not even a misdomeaner.
> Lack of Candor Under Oath, Offense Code 2.6:
Yeah. :-( They couldn’t get him on anything else, really???
“But note that this report is about certain allegations relating to McCabe. There could be more to come, we have no way of knowing...’
I didn’t read through it, so I don’t know about any “allegations” or even if he possibly violated prosecutable crimes.
“SES”????
FBI jargon.
The DOJ & it’s rank and file are 100 percent, within the margin of error, rabid lefties—100 percent hillary voters. 100 percent contributions to that treasonous murdering harpy.
What don’t you understand about that fact?
Isn’t the more important question, Why was he motivated to act in this way? Isn’t that the real crime and who was “in” with him on this?
Yes. But apparently you can’t.
But breaking FBI’s policy and breaking the US Code could be 2 different things.
On what would they criminally prosecute McCabe?
I have read about one third of the OIG report.
It sure would make it easier to read if the OIG named NAMES instead of using job titles of the co-conspirators.
LOL! Well, I've been at this for 40 years. Just keeping track of how bad we are getting screwed by the deep state and the government takes up most of my time outside of work. A cognizant citizen does have time frivolities of sports hero worship. I could give a rats ass about pro and college sports of any type. Too many more important things to be involved in.
Bttt.
5.56mm
If the wrong person/body was lied to, then it could get criminal. But I’m not sure they will go there.
What goes around comes around...
Lied during IG Horowitz interview .
BOOM
Until we see some one get cuffed and sent to Lewisburg or Atlanta, this means nothing. This is just a sop to the right..
You asked...
Is there a law against lacking candor?
Under oath? Yep.
