Full Title: Justice Department violated Michael Cohen's constitutional rights just by seizing his records, Alan Dershowitz tells DailyMail.com – hours before Harvard law professor has dinner with Trump

A famed Harvard legal scholar is raising concerns about the Justice Department's ability to responsibly handle some documents seized Monday from Trump lawyer Michael Cohen's offices.

Among the scooped-up papers, and lurking on phones and hard drives, is likely to be a cache of material that's covered by attorney-client privilege.

Prosecutors are not permitted access to those files, and the DOJ's standard practice is to set up a 'taint team' – a group of agents and lawyers not connected to the Cohen case or the special counsel probe into all things Russia – to decide what they can see.

But 'taint teams don't work,' Alan Dershowitz told DailyMail.com on Tuesday, because seizing the material in the first place was a violation of Cohen's constitutional rights – even if it's never used in court.

Isn’t the lawyer rather covered, if Trump has the ability to overrule any and all law enforcement with a pardon?

The purpose was to smear Trump, because even if this information is perfectly legal, it will be a cloud over him for the remainder of his term.

I am beginning to think this is a take-down in progress of the rats in the SDNY offices of Justice and FBI. The narrative is this was done to cause Trump to act impulsively and fire Mueller. Instead, Mueller issues a referral for a rather specifically small focused on the reported payoff.

The corruptocrats at the SDNY saw an inch a decided to take a light year thinking they were covered by the DC corruptocrats in a stunning display of total arrogance.

Schneiderman and the recently departed USDA Bharara will also be found to be mixed up in all of this.

The idea from the swamp is to force Trump to correct what they have done by issuing a pardon. In order to accept a pardon one must first admit that they did whatever they are accused of. That implicates Trump in whatever the charges by the swamp implied. So, a pardon is a bad approach as it forces the president to, by proxy, admit to being a part of or condoning whatever scheme the swamp dreamed up.

The “justice” department is not about justice. It’s about politics.

Dershowitz is now a Fox contributor and thereby is on their various shows almost daily. And, while he presents himself as a Democrat he seems to be in Trumps camp and is no fan of Mueller. However, Dershowitz states whenever the topic comes up that Trump should not fire Mueller. And, I believe that’s what his advice was to Trump last night during their dinner.

Democrats screamed about their 4th Amendment protections when the Patriot Act was signed. But I guess those protections apply only to them.

He would know better than 99% of everyone else. Guy taught constitutional law at Harvard. Pretty good credentials, methinks.

Would be excellent to see some immediate counterattack by Trump’s friends, in the way of court filings to quash, etc.

The contrast with the kid gloves, buttkissing, bootlicking approach of the “Justice” department and FBI to Madame Clinton and Trump is sickening. Destruction of evidence, transfer of much of the nation’s uranium to Russia, no transcript of their phony “interview” of her, failure to follow up on destroyed hard drives, yet when it comes to raiding Trump’s private attorney’s office, they will stop at nothing.

HOWEVER, if he fires Rosenstein, that will open door to getting rid of Sessions.

I believe Mueller will get caught up in the NEW Investigation that Senators are talking starting after that raid, it’s about Dems and Russia (Uranium One), and Mueller took that sample to Russia for Hillary, when acting FBI Chief. Ironic.

It’s the dysfunctional family model. The violent, abusive family member is treated like a king in order not to trigger the violence everybody knows he or she is capable of. Meanwhile, the low-status kind, gentle family member is abused at will to curry favor with the abusive member. It’s mirroring behavior.

I saw this repeatedly in companies where an alcoholic who was costing the company lots of money was handled with loving care and the top line, hard working employee was fired for something the other man did.

Mueller, Rosenstein, and Wray are using the cover of their "un-fire-able" positions to engage in wholesale political espionage. They are trolling through everything connected to Trump, gathering all info available, which will be used and leaked as needed. They are collecting invaluable political intel that would simply have been unreachable by conventional means.

They did not particularly go after what they considered illegal based on a known crime.

They went after everything.

They clearly violated his 4th amendment rights.

This MUST be true because he was cooperating. They could have asked specifically for what they wanted.

Huge constitutional violation
