She filed a lawsuit against him. This is a counterclaim. Under the common law legal principle known as the "Doctrine of the Unclean Hands," this may just be a legal maneuver to get her lawsuit dismissed.

Basically, what he's saying is that she has no legal standing to sue him for defamation if she already defamed him.

(a) It's in state court, not federal.

(b) It's not really his suit. She sued him for defamation for calling her a liar. He tried to get the case dismissed and, when he lost, he filed a counterclaim. He hasn't sued any of the other women who accused him.

Way too late. The MSM will never cover it, the offenders have no $ so he can’t get monetary reward and Moore’s political future is too damaged for him to go anywhere.

And Moore doesn’t have deep pockets, apparently. But the true problem in this suit is if it limits itself to the woman and the Washington Post - and it limits itself to what happened to Moore directly.

The real problem is not that the WaPo committed libel but that the whole MSM joined in. The real problem is that the Associated Press homogenizes journalism. And what happened to Moore is nothing that didn’t happen to just about every Republican that ever came down the pike. What is needed is a class action suit to bankrupt the AP.

Judge Moore is not just a public figure, he is also a political figure. In short, he cannot prevail even if she knew everything she said about him is a lie.

The standard is higher, however, if he has proof, he will prevail.
