According to the enumerated powers afforded the executive branch by the constitution it is the primary duty and the use of military force (not just NG) is 100% justified and legal.

Even worse, we here had a navy on staten island for a while and jets would have been maybe 12 miles away at the time of the attack.
Not sure why it closed. But an entire base was built here. And an Entire area of housing far from the base was built.

Hmm, I don’t’ believe that in a second. There are a few bases in the U.S and Caribbean that maintain alert interceptors.
I think that was knee jerk answer to the reason why they weren’t intercepted as soon as it was recognized as an attack. Fact is, we didn’t recognize it as an attack until afterwards.
