US judge opens door for thousands to apply for asylum

SEATTLE — A federal judge in Seattle opened the door Thursday for thousands of immigrants to apply for asylum, finding that the Department of Homeland Security has routinely failed to notify them of a deadline for filing their applications.

U.S. District Judge Ricardo S. Martinez issued the ruling in a class-action lawsuit brought by immigrant rights groups on behalf of those who fear persecution if returned to their home country.{snip}

Government lawyers argued that they do publish some materials that inform asylum seekers of the deadline and that federal law does not require that officials directly notify asylum seekers of the deadline upon their release from custody. The judge disagreed on the latter point and said the former wasn't good enough.

Judge has a fair point. If you’ve ever helped someone through a legal immigration-naturalization process it’s impossible to ignore how Kafkaesque the system is for people who are trying to follow the rules and do the right thing. That’s one of the contributors to illegal immigration, as illegals don’t have to deal with a torturous bureaucracy.

Applying for political asylum is the latest immigration scam in the playbook.

The Trump admin is trying to tighten up on the process - for example, let asylum seekers know within days instead of months or years, whether they can stay in country to make their case. As it was, folks would apply for asylum, work here illegally for 3-4 years, then return home with their ill-gotten gains once their flimsy application is denied.

The applicants were not making a serious application for asylum. They just wanted to work here illegally for a few years.

Hopefully it’s like those car commercials: “All credit applications will be accepted.” Accepted is not the same as approved.

I’d like to see the UN make itself useful and set up localized asylum areas worldwide. These areas would have roughly the same culture, majority religion, language, etc as the people seeking asylum. Trump proposed this for Syria during the election with Safe Zones. Once the crisis that caused the issue has subsided they could return. Always thought it was a good idea.

That’s one of the contributors to illegal immigration income tax evasion, as illegals tax evaders don’t have to deal with a torturous bureaucracy.

In other words: The same argument could be made for virtually any other form of non-violent criminality: It's too hard to follow the rules; the Kafkaesque system is too complicated to understand / follow; it's unfair to expect people to deal with a "torturous bureaucracy."

Bottom line: It's just as difficult and frustrating for us legal citizens (to "fight City Hall"), so get used to it!

Eventually the courts are going to get so burned with this anti-Trump political ruling.

Ignore the court. Put everything they [low level federal judges, high level state judges] decide on these political cases, declare them political and stay any decision you don’t like until heard by the SCOTUS.

This is the best way to strike back at the courts without undermining the Judicial system. Right now, the judicial system is undermining every facet of law making and decisions arising from enumerated responsibilities of either the Legislature or the Executive.

Your substitutions are good ones.

Your conclusion is terrible. The tax code is a prime example of laws so complicated that no person could ever really know if they are in compliance or not.

Laws that are too complicated for the average person to understand are a particularly insidious form of tyranny which should be the object of repulsion, not a touchstone for how things should work.

I don’t want any of these Guatemalans here any more than you do. I personally favor a “we’re full sorry” immigration policy. BUT I am not willing to throw away the principle of the Rule of Law just to spite them.

If it mitigates your concerns any, people who pursue asylum claims tend to be much better prospects than those who outright defy the law. They’re working within the system, which is exactly what we require of them.
