Yes, Judge Sullivan is one solid judge, what we imagine a judge to be. I’d trust his judgment any day of the year over most on that or any other court.

I keep hearing this about Weissman, but has HE ever faced any disciplinary action for withholding evidence? Has he ever been brought before the bar counsel? Why would Meuller hire him for this investigation (rhetorical)? Why is he being paid by USDOJ (i.e., taxpayers)? Can he receive the same treatment, ultimately, as McCabe, i.e., having his pension affected through a firing?

The prosecution has to turn over everything at that point and anything new in the future that that they may have come up with. The deference does not have to turn over anything. Familiar with this because of a murder trial involving two members of out family that were killed. There was a lot that has come out about the FBI and things they did and said I would bet Mueller dot not inform the defense of this. Why he had his judge and everything was going great until he was kicked off the case and a new judge came in.

Weissman still has a senior job at the DOJ and is serving on Mueller’s legal team. Any disciplinary action was inconsequential.

Couple of points. Andy McCarthy's criticism of Team Mueller's charging pattern is in relation to the Gates, Manafort, and 13 Russians cases. Lots of breathless prose describing massive crimes, followed by charging a minor offense.

The Flynn case does not follow that pattern. The Flynn case looks like a case of pure prosecutorial discretion - abuse or not, or some lesser prosecutorial offense is in the eye of the beholder.

Second, the "Entire Controversy Doctrine" is a civil law notion. Criminal law works on different principles in this regard, generally governed by prosecutorial judgment and statutes of limitations. A given set of facts can't be used to try a person over and over on different criminal statutes that fit the fact pattern. But using Flynn for example, if he also perpetrated tax fraud, murder, and a host of other crimes, the prosecutor is free to sit on those cases while prosecuting a "lied to the investigator" case, because the fact patterns of the hypothetical crimes are not joined to the fact pattern that produces an allegation of lied to the investigator..

It was revealed in the Sztrok and Paige texts that a personal relationship existed between them and Judge Contreras. The content of those texts implied that they were or would coordinate with the Judge.

My real question is: How can someone with Weissman’s record still be on the U.S. government payroll? How can he still be a member of the bar? It’s outrageous.

Hopefully as this whole BS investigation winds down, he’ll face his own set of consequences.

Doesn’t say Contreras was presiding of the FISA case for Carter page.

I am hoping to find out that he was the approving FISA judge. That would confirm my speculation:
- first warrant rejected in June 2016 (not Contreras)
- Strozck waited for his buddy Contreras to cycle into the court before presenting the appeal (October 2016). Because of his relation ship with Contreras, Strozck knew when Contreras would cycle in and had given Contreras a “heads-up” on the appeal.
- It was worked out that Contreras would then approve the renewals by “fiat” because he was original approving judge; all Strozck had to do was push paper and phone Contrerars.

You want a “collusion” case...there it is.

To be fair to Contreras, the court filings, from the charging document to the plea agreement, took only a few days. It was a completely canned deal, without presentation of evidence or arguments to Contreras, or any sort of defense offered by Flynn. Contreras just rubberstamped a few pages of bare-bones paperwork. He might be a swamp thing, but for the Flynn case, he was basically a filing cabinet.

The very brevity of that process is why a diligent judge would have to review in full the evidence behind the case, before determining an appropriate sentence (the charges amount to Flynn falsely denying that he asked the Russians not to harm US interests; if that is all Mueller has, the sentence should be nothing.) Contreras might have been recused from the sentencing phase due to his Strzok connection. Or perhaps someone did not want Contreras to see the full case.

Thanks for the link, and for clearing up AlbertasChild’s issue about the Entire Controversy Doctrine. I do not contend that the USA v Flynn filings and paperwork were procedurally flawed. My crank theory is that the case we see publically is a deliberate nothing, designed to move Flynn off the chessboard as a foreign policy/security player permanently, without airing things troublesome for the US (including the IC and the Trump administration). Sullivan had no choice but to require Mueller to turn over everything the SC has on Flynn, since the material shared with the court was evidence free.

Not a bad theory. But Mueller and Strzok and Weissman being jerks also explains the criminal action taken.

Still, entanglements with Turkey may have been troublesome, and "found too late."

Judges are all quirky, no two alike. Sullivan is trying to run a tight ship, and if the government fails to turn over excluppatory evidence, that creates a vector and risk for a future appeal. He could have just sentenced Flynn, but it's not in his genes.

Yes, but that does not reveal what Robert Mueller is really doing. Gen. Flynn is not stupid. We shall know when we know and Mueller will either deserve a medal or prosecution.

Thank you for that link. I’ve been trying to find out who those guys were for weeks - no great loss, being mobsters themselves, but the FBI doing this makes them to be just as crooked as the Patriarca thugs.
