The McLennan County District Attorney's Office dismissed the case against Twin Peaks shootout defendant Cody Ledbetter on Monday, four days before a jury panel in his case was supposed to report to court.
The dismissal, signed by prosecutor Michael Jarrett, says that while probable cause remains in the case, the state is focusing on more culpable defendants in the Twin Peaks shootout, which left nine dead and dozens injured.
Ledbetter, a 28-year-old diesel mechanic, and his attorney, Paul Looney, of Houston, eagerly snatched up the April 2 trial date that had been reserved for the retrial of Jacob Carrizal, president of the Dallas Bandidos chapter, whose trial in November ended in mistrial.
Carrizal, who has a new attorney, asked the court last month for more time for his attorney to prepare.
Ledbetter, who has said he has been ready to go to trial for almost three years because he didn't commit a crime, witnessed his stepfather, Daniel Boyett, get shot during the May 2015 brawl between two rival biker groups. Boyett died from his wounds.
"It is just time to go in and lay the cards on the table and let the jury exonerate this man," Looney said last month. "He has been innocent and on bond for three years. That is a torture that no innocent person should have to go through. It is time for it to stop, and we are finally in front of a group of people who can finally make it stop."
Looney filed a motion to disqualify McLennan County District Attorney Abel Reyna in October after it was discovered that the DA's office released videos from Ledbetter's cellphone that showed Ledbetter and his wife having sex. The videos were sent to more than 125 attorneys as part of the massive Twin Peaks discovery process.

The DA was expecting all the defendants to accept plea bargains, and is not willing to actually have to prove his cases in court, with witnesses under oath and subject to cross examination.
OH my Word, thanks for this info,this stuff is so Twilight Zone unbelievable.
I have no love lost for biker gangs, but I have a much greater love for the Constitution. It’s about time the case against this man was dropped. Hope he sues and and wins big. He’ll win, plus get his attorney fees back.

Now that his case has been dismissed, he can start with his civil lawsuit for false arrest and unlawful imprisonment. This one will go to trial.
