I do not believe any of the answers in the 1st question are correct, as the FBI was created by Attorney General Charles Bonaparte in 1908, not Congress. Congress did create the DOJ in 1870. The other 2 answers are also somewhat ambiguous as the FBI does contain a certain amount of independence, even though the FBI falls under the Executive Branch.
