A British Columbia First Nation is claiming title to a private island off Victoria that is currently owned by one of the world's richest men and is valued at more than $54-million.
James Island, the largest privately owned Island in B.C., is currently registered to J.I. Properties Inc., a company owned by telecommunications billionaire Craig McCaw.
He bought it in 1994 for $19-million, but in documents filed in B.C. Supreme Court the Tsawout First Nation says it has never surrendered James Island or the title and rights guaranteed by a 1852 treaty with then Vancouver Island Gov. James Douglas.

Along with a request for damages, the First Nation also seeks an order for J.I. Properties to transfer James Island to the Tsawout and it calls on Canada and British Columbia to compensate the company for handing over the land.
None of the claims has been considered in court and J.I. Properties and the federal and provincial governments have not yet filed responses.
The B.C. Assessment Authority says James Island is currently assessed at $54,433,000 while Bob Ratliffe, vice-president of Craig McCaw's Eagle River Investments confirmed in 2001 that, along with a main home, there are six guest cabins, a Jack Nicklaus-designed golf course and a private air strip.

Decades ago I worked a maintenance job with a skinny bean pole of a guy who married a Cherokee tribe member (NC) and used to brag about living in a free house on the Res.
First time I saw his wife was on pay day when she’d drive over in an old station wagon with a pack of kids from a prior marriage to pick up his paycheck.
Looney Tunes’ caricatures of a fat squaw don’t do justice to the rotundness of this woman. The two of them together reminded me of jack sprat and his wife.
I hope his free house was worth it.

Why did they wait so long to make a claim. They certainly had plenty of private notice of prior sale activity involving the island as well as unlimited chances over the years to step and say something. Any court with its salt should ask - Why now? Why never before now?
Taboo was a great show - one of the few things on TV recently I have liked.
I would also make sure that golf course was irrevocably destroyed.
The Indians want the island to make another resort casino without having to invest any money.
No such thing as "bomb proof", just varying degrees of bomb 'resistance'. Makes the entire exercise more fun!
Prior chemical and explosives plant was located upon the island, and had a negative influence on a prior development plan for residential real estate. This is not the first claim against ownership.
Douglas Island, BC lies outside of the recognized treaty boundaries.
