As far back as 167 B.C., Cato the Elder pointed out that you can't be prosecuted for just thinking about violating a law. But of course the Romans did not have to contend with the Ninth Circuit.
If the supposed conversation between Trump and the White House counsel took place when only two people were present, and assuming that the counsel is not leaking to the enemy media, it would seem that the story must be based on a leak from Mueller's team (whether Mueller ordered it or not).
