Rancher Cliven Bundy is seeking a judicial ruling that the federal land in Nevada on which he was grazing cattle belongs to the state of Nevada and the people of Clark County, not the U.S. government.

I hope he’s successful, but what court has actual authority over the feds?
Sadly, his odds that a Federal Judge will agree with this argument are - 0.
And a State Court decision is (obviously) not binding on the Feds. So, if he does “win” in state court, it will be a symbolic victory only.
That is U.S. land, always has been since what, 1805. NEVER WAS NEVADA LAND, NOR CLARK COUNTY. This idiot likely will find himself back in jail if he continues his thieving ways. These are U.S. lands, our lands. Wants to use them for commercial purposes, do like everyone else, pay for those grazing rights and not be a thief.
Payback time? Heck, by the time he’s done, he’ll be dead and broke, leaving his wife and kids in poverty. Oh well, guess they’ll just collect welfare and continue their lifestyle of living off taxpayer largesse.
Troll much?
So do I. I am not much of a fan of government.
Mr. Bundy seems to have a more originalist view of our Constitution than Republicans and the “Conservative Movement” do.
In this world of phony baloney politicians I find Mr. Bundy a bit refreshing.
Too much. He seems to think the Bundy’s fighting the agency attempting to put them out of business is thievery. That agency would be the Federal Government who has succeeded against every other Clark County rancher so far.
Trolling has nothing to do with this—and this is not a conservative or non-conservative litmus test. I grew up mostly in the west, now living in Nevada. I appreciate that 82% of the state is federal lands, which means we can access and enjoy. I recognize that there are responsible commercial opportunities that might occur on or with these lands, which might help pay for their stewardship. What bothers me is when usage is stolen (aka Bundy), given away for below-market rates, or when they are damaged through commercial use. It also bothers me equally when do-gooder government folks block off our access.
What are the feds doing with these lands now that they're no longer allowing the farmers to keep the weeds down? You tell us.
If memory serves, there were some slightly different rules when Nevada became a state. Water rights being part of that. Technically, except for military related lands, I believe the state owns the land and the federal government is just a caretaker. This has morphed into the belief that the Feds own the land. Some believe that Fed land ownership underpins the currency. It is really the economy that underpins the currency.
“These are U.S. lands, our lands.”
Actually, ALL the “Federal Land” in the Western United States was TAKEN as RANSOM in exchange for being ALLOWED to join the United States! Something on the order of 87% of Nevada is “Federal Land” as a consequence, while way back East in Taxachusetts, that number is something on the order of 3%. $hit, the Feds own 45% of California, and for what purpose? Cliven Bundy may be on a fool’s mission, but he’s right as rain. It is long past time when the United States Federal Government be forced to give up these ransomed lands, and start adhering to the Constitution’s prescription for just being ALLOWED by the states to hold no more land than it needs to discharge it’s CONSTITUTIONALLY-MANDATED RESPONSIBILITIES. It is complete BULLSHIT to say the federal government is holding onto OUR LANDS! Normally, I agree with most things you write, but you are full of it on this subject.
BTW, my wife’s grand parents came to Fallon, from the Midwest to get “federal land” there to farm, but they got $hit for their trouble. My father-in-law tried to make a living dairy farming in the Overton Valley (Bunkerville) but it turned out not to be possible. So he regrouped and started his own business in Nevada. Now, it’s a $500 million a year enterprise, no thanks to the Federal Government, which he hated to the day he died!
The abuses of the decent, hard-working people who work to try and make a living off the land in Nevada ( and most of the other Western States as well) suffer on an ongoing basis at the hands of the BLM, leave me wondering why the Bundy’s didn’t take the opportunity to shoot all the bastards from the BLM who showed up to try and murder him so Harry Reid (the #1 worthless bastard in Nevada) could make some ill-gotten gain from the land on which the Bundy’s were running their cattle.
Their trial in Las Vegas and the one in Oregon, just show you the lengths to which our criminal Federal Government will go to try and silence decent people seeking redress for the abuses they have suffered at their hands.
And FWIW, count me as one who wants all these para-military adjuncts to the various Federal Agencies like the BLM disbanded. There are just too damned many armed “agents” in Federal agencies going around pushing around the citizens of this country and leaving their guns unattended in their cars so illegals can steal them and shoot us with them as was the case with Kate Steinle.
I don’t preach Uranium One but it smells like some folks think the land out West should be exploited by big business and shaft the little folks like Bundy Ranch (160 acres).
Corporatism, big business first and so on.
Troll much?
You are one of the best trolls.
Oppositionally defiant but at at least you make cogent positions.
Always authoritarian, big govt but a true leftist liberal just name calls.
Hey, liberals, at the least, act out this way.
But the answer here is the Federal Govt is only allowed to own minimal land for buildings etc per ol Constitution. People made an exception for nuclear testing grounds.
The ranchers are providing goods for the people. The Feds are providing sh**.
States like Illinois were like Nevada but eventually the people took back their land. Nevada will also get their land back and Bundy will be a historical hero in land people rights.
I would also like Colorado to take back their river because Southern California will just drain it dry. If land history does not matter in Bundy Nevada, it should not for wet California.
Lawsuit will fail due to the constitution of the state of Nevada.
"That the people inhabiting said territory do agree and declare that they forever disclaim all right and title to the unappropriated public lands lying within said territory, and that the same shall be and remain at the sole and entire disposition of the United States; and that the lands belonging to citizens of the United States residing without the said state shall never be taxed higher than the land belonging to the residents thereof; and that no taxes shall be imposed by said state on lands or property therein belonging to, or which may hereafter be purchased by, the United States."
Sorry, Bundy. No take-backs.
