NEW YORK (Reuters) - Eight northeastern states said on Tuesday they sued the U.S. Environmental Protection Agency to force it to impose more stringent controls on a group of mostly Midwestern states whose air pollution they claim is being blown in their direction.
In the latest development of a legal saga that began during Barack Obama's presidency, the lawsuit by New York and seven other states challenges a Trump administration decision to allow nine upwind states to escape tighter smog pollution controls.
"Millions of New Yorkers are breathing unhealthy air as smog pollution continues to pour in from other states," said New York Attorney General Eric Schneiderman, who led the coalition of states that filed the lawsuit dated Friday.
The coalition urged the U.S. Court of Appeals for the District of Columbia to overturn the EPA's decision not to add the nine upwind states to the congressionally created "Ozone Transport Region," which requires stricter pollution controls.
An EPA spokeswoman declined to comment.

These states are just preparing for the moment their citizens see their federal taxes skyrocket, and begin to realize how badly they’re being fleeced by their state .govs.
Gotta find a new source of revenue. Like other states.
It’s past time Ohio politicians play along. These New York bastages have been dumping thousands of tons of trash in our state for decades. Tit for tat.
The lawyers at the EPA will decree that the winds will blow from east to west.

Instead, they need to sue the sun for creating the winds that generally blow from west to east in the northern hemisphere.
This is key. Unless the drifting air causes them to go over the legal limits, they have nothing to complain about.
Scheiderman said the EPA's own studies show that pollution from upwind states substantially adds to harmful levels of smog in New York, and cited an American Lung Association report showing that the New York City area ranks as the nation's ninth most smog-polluted city.
So they are just whining about a small amount of pollution drifting over. They have no case and it's an executive decision anyway. The Obama regime didn't think the Midwest states should be added either.
Reminds me of the same set of NE states suing the midwestern states for acid rain in the 1960s & 70s.
The only reason the northeast has clean power is that the Niagara River Robert Moses hydro electric plants put out enough power to not to have coal fired plants.
I guess Europe will be suing New York City for all the pollution coming their way from cars, motorcycles, subways, taxi’s, buses, heated and air conditioned building exhaust, not to mention the Staten Island Ferry and the power used to heft that ball up in Times Square for New Years Eve.
