Former Judge: If General Flynn Was Not Aware Strzok Was Removed for Bias – Case Can Be Dismissed Due to Giglio Violation December 5, 2017 by Jim Hoft 9 Comments

Glenn Reynolds is a law professor, author and USA Today columnist.

Glenn runs the wildly popular Instapundit website at PJ Media and has an enormous following.

This afternoon Glenn Reynolds posted this comment from a former judge and reader on the General Michael Flynn arrest and plea deal.

Glenn believes this was a flawed investigation because General Michael Flynn was not notified that the main witness against him was removed from the investigation for bias. If General Flynn was not aware of this it is Giglio violation. Via Instapundit:

A READER WHO IS A FORMER PROSECUTOR AND JUDGE EMAILS:

Did the prosecution tell Flynn’s lawyer that their main witness against him was removed for bias? Since Strzok led the interview and his testimony would be needed to establish untruthfulness, he is a critical witness not just a prosecutor. If not disclosed, would this not be a Giglio violation? This is the kind of misconduct that can get a case dismissed and a lawyer disbarred. It is a Constitutional violation. This has bothered me since I heard about it.

Me too.

The Giglio versus United States case: is a United States Supreme Court case in which the Court held that the prosecution’s failure to inform the jury that a witness had been promised not to be prosecuted in exchange for his testimony was a failure to fulfill the duty to present all material evidence to the jury, and constituted a violation of due process, requiring a new trial.

Nice, but that's the wrong photo for Strzok, I think. It's been discussed on another thread that the photo you have was some FBI security guy accompanying Mueller to a hearing.

So DOJ IG Horowitz removed Strzok back in August and still both Mueller and Horowitz didn't inform Flynn until now?

And IG Horowitz is supposed to be a good guy?

Thanks for sharing that and I watched the video. The other fellow who was there had me laughing after a while with his remarks, from seeing just how far his TDS insanity was advanced.

Andrew Weissman was guilty of this in his prosecution against Arthur Anderson where he failed to provide the defense with evidence he obtained that would have exonerated the people he was prosecuting. Subsequently the convictions were overturned.

Can do the same with Mueller’s deputy Andrew Weissman.

I said before - Flynn should withdraw his guilty plea, and go to war on Mueller and his gang of swamp-dwellers. He can and should accuse Strzok of anything and everything.

With more pressure, more information will leak about about the office place sexual predator Strzok and his Clinton corruption.

you can’t go to war with an empty ammo box. or in this case, wallet. With the threat of going after his son hanging over his head..

Smells like a thoroughly rotten stew of corruption, influence peddling, quid pro quo, kickbacks, bribery, and you name it.

OK. I'll name it.

...and a little murder.

Agree about Weissman; this is some lousy bunch Mueller has hired. WHY is the clown Strozk still on the federal payroll? WHY is he not before Congress testifying about being the key FBI agent on BOTH the Clinton and Trump investigations and his vastly different treatment of the two? The FBI is not our lord and master - they work for us. This is the weaponization of a federal government agency against its citizens - I suspect its been going on since the murder of Jack Kennedy, but they feel their superior, heretofore unchallenged position is now threatened. When people like this get too much power, they get arrogant and stupid and make remarkably dumb mistakes. In my view, this clown Strozk along with Comey and Mueller, are just that. “When the Congress calls my name, who do you think you’re fooling? I’ve got the presidential podium and the presidential seal”. Art Garfunkel in 1974.

‘go to war on Mueller and his gang of swamp-dwellers’
Does he have that kind of money? The Swamp-Dwellers have unlimited funds. ($6.7million in 5 months)

I remember that lyric from Paul Simon’s solo song: ‘Loves Me Like a Rock’...summer of 1973.

I am more disturb that Flynn was “interviewed” by the FBI without an attorney for Flynn being present. Sneaky, underhanded, and CORRUPT.

How can we not fear this government?

“Horowitz is supposed to be a good guy”

What makes you say that? This guy got his IG gig during the Obama administration. I’ve yet to see a single non leftist rat felon type get a job with Barry’s crew. I know next to nothing about Horowitz but would sure like to. My money is on this guy being a whitewashing enabler for the corrupt deep state.
