Double jeopardy argument there though.

I think the charges are #2 here.

Double jeopardy only applies to being charged twice in the same jurisdiction. This is why someone like Mcveigh could have been charged with 168 homicides in Oklahoma as well as at the federal level.

IIRC, it’s a Federal crime for an illegal to possess a firearm. No double jeopardy.

Likely a warrant for re-entering the USA after being deported. Can be sentenced to jail time for that.

It is one thing for a felon to possess a gun, it is another to discharge it within a City in a public place that ends up killing someone. I think the city letting a felon go after ICE advised that they wanted him & the officer who had the gun stolen are culpable as well.
