Why would you want SCROTUS to rule on it? Are you saying that the one branch that is un-elected, the judiciary, gets to decide the constitutional parameters & powers of the other elected branches? To be the final arbiters? To give a green or red light to every decision the executive makes? Might as well put the judges in charge. /rolleyes
Scrotus has the power to VACATE these unconstitutional edicts of the lower courts. They haven’t.
Because that’s the difference between a Tyrant and an elected President.
