Send him to Gitmo and some judge somewhere will order him back to the U.S. for trial. Better just to try him, convict him, sentence him, and lock him up. If you don’t trust New York to do it then try him in federal court.
He’ll definitely be tried in Federal court, since New York doesn’t have a death penalty.

There is no death penalty in New York. Send him to Gitmo. Try him there with a military tribunal and execute him under Federal Law.
