The watch commander who was on duty when a Salt Lake City police officer arrested a University Hospital nurse last summer is appealing his demotion, claiming it was excessive discipline.
Lt. James Tracy was demoted to the rank of officer last month after the police chief determined Tracy made the completely unreasonable order that Detective Jeff Payne arrest nurse Alex Wubbels on July 26, after she refused to allow Payne to draw a patients blood.

If this guy was a big prick, it might not be fun to find himself on equal footing with former subordinates, and below sergeants who used to work under him.
Exactly! It might need to specifically include politicians, bureaucrats, and other government workers.
Otherwise, the courts might somehow find an exclusion implied in the words "all citizens."

Every cop within 30 yards of the incident needs sufficient punishment to make him share the story with his great grandchildren. Including and especially the cardio-challenged University cops.
That was my thought too. He should be considering himself lucky to still have a job yet he's appealing his demotion? He may find himself fired after all.
His judgment is definitely faulty and he has no business being in a position of authority over others which also means he is not LEO material IMHO. I hold LEO's to a higher standard because of the extra rights and privileges they get to do the job they do. With those extras comes extra responsibility. Yes?

If you want credit for the sunshine, you gotta take credit for the rain. Period.
These morons are entitled to their day in court, but unless it is a kangaroo court, the chief’s decisions will prevail. I hope the nurse has her day in civil court, and relieves both the city and the officers of a portion of their wealth. The nurse did her job to the nth degree. The policemen earned a zero.
Assault and false arrest charges would seem to apply here.
We used to call this:
Felony Kidnapping
Conspiracy to Commit Felony Kidnapping
Extortion
Using a Firearm during the commission of a Violent Felony
Unlawful Imprisonment
LIFE IN PRISON is the only proper response.
and many many more charges that would be brought against any person not in possession of a Magic Blue Costume.
This is a really weak argument. He only said Detective Tracy should consider cuffing the nurse. He should have been fired for even considering it. What a joke!
