A federal judge on Wednesday denied an attempt by the state of California to force the Trump administration to pay billions of dollars to insurance companies to subsidize health plans for low-income Americans.
California and 17 other states sued the Trump administration, arguing that its decision to end the payments was unlawful. As part of the lawsuit, the states sought an emergency temporary restraining order from the U.S. District Court.
Attorneys for the states failed to convince U.S. District Judge Vince Chhabria that there would be immediate harm to consumers if the payments are not reinstated.
It appears that because of the measures taken by the states in anticipation of a decision by the administration to terminate the (cost-sharing) payments, the large majority of people who purchase insurance on exchanges throughout the country will either benefit or be unharmed, Chhabria wrote in the ruling.

Vince Girdhari Chhabria is a United States District Judge of the United States District Court for the Northern District of California and formerly a Deputy City Attorney at the San Francisco City Attorney’s Office.
All the more amazing is that he lives in Marin County!
Wait a minute, someone in President Ninth Circuit’s office did not get the memo. Looks like this needs to get kicked up stairs to the big guy (the Actual President Ninth Circuit).
I am sure President Ninth Circuit will hold the Constitution unconstitutional and make it not only A-OK for the Executive Branch to originate and control spending but make certain that it be required (at least when it comes to spending that liberals like).

U.S. District Judge Vince Chhabria only ruled on the basis of harm to consumers. The decision on the facts of the case wont come til 2018.
All he did was look at consumers based on the CA argument. Had he found sufficient harm - if CA had not ironically undercut their case by moving to mitigate the effect to consumers in anticipation of the Trump order - he would likely have ruled differently.
Read the articles, folks. (not preaching...I sometimes hit-n-run comment on the excerpt as well)
So he denied the injunction but allowed the case to move forward. Happens all the time. Obmacare may very well collapse before the court can render a decision on the merits.
