Anyone within a mile of libertarianism on the political spectrum will dry-heave upon reading this but I admire the cunning behind his pander. Moore could have gone with a tried-and-true call to arrest all flag-burners, as there’s a large audience receptive to that argument within the GOP, but it wouldn’t have been topical. Nationalists would appreciate it but it’d have no bite. Suggesting that the Kaepernicks of the world are guilty of a federal offense while the debate over NFL anthem protests is raging, though?

The operative word in Section (b)(1)(C) is “should”, they are not breaking the law. The players are ungrateful jerks but they are not compelled by law to show respect, at least not in the citation your have provided.

The legal usage of these terms is different from Software Standard usage of years ago, where a “should” was essentially a “must”, and “may”/”should” were optional. With a slight variation between “may” and “should” - should is recommended, while may is giving an option to do, without any particular comment on doing it.

There’s no law there to comply with.

If they ever change it to SHALL, that would be law — unjust, unconstitutional, and unworthy of free people — and at that point I too would be defying it.

should is not compulsory in law. I am not defending anyone. I have stood for the National Anthem of our Nation since is was 5 years old. I saluted our flag since the first day in the first grade when we swore the pledge of allegiance. I personally think what these people is doing is stupid, asinine, and just plain fucked up, but this is America, they have a legal right to sit out the Anthem, and the Pledge.

Hoping this guy doesnt go full Todd Akin.....if he shuts up he will win in a landslide.

Media is already sitting around planing all the gotcha abortion questions, trying to trap Moore into saying anything they can use to blow up his campaign. He seems like a much smarter man than Akin, but as a relative political novice, it can be easy to walk into media traps.

The players have a Constitutional right to protest the way they do.

I am bothered that a Judge would make a comment like he did but you are off base as well. The players are in an employment roll on the field. The Constitutional limitations on Congress making laws restricting freedom of speech don't apply in this instance. If the NFL wanted to fire or penalize they are within their rights.

Rights arguments are largely like genitalia comparisons. Often not appropriate for the situation and so much chest puffing.

Where any Florida "duty to retreat" comes in when the issue down there is the Castle Doctrine which holds to the contrary, I do not know.

Bannon as an individual is fine but the Breitbart News attitude of hyped crisis is no way to compose campaign statements would be my advice to Moore.

Your ignorance is showing. They are in violation of the law when they take a knee. There may be no official punishment for this act of disrespect, but it is a violation of the law.

No, they do not. Employers can control what their employees say and do when they are at their place of employment.

One only has a right to speech in public places or on their property, not on someone else's property.

While the national anthem is being played, people “should face the flag and stand at attention with their right hand over the heart.”

It is the law. If it shouldn’t be the law, it should be repealed. Personally, I don’t think it should be a law.

I would disagree. The law uses the terms “may” and “should”. It does not use the terms “will” and “must”. To me this means that those actions stated in the law are at the individuals option and are not legally mandated.

I believe the word "should" indicates a "moral obligation".

So the law says that everybody not in uniform has a moral obligation.
