A federal judge in Chicago on Friday refused to alter his previous ruling barring Attorney General Jeff Sessions from requiring sanctuary cities nationwide to cooperate with immigration agents in exchange for receiving public safety grant money.
In granting the preliminary injunction last month, U.S. District Judge Harry Leinenweber said Mayor Rahm Emanuels administration could suffer irreparable harm in its relationship with the immigrant community if it were to comply with the U.S. Department of Justices new rules. The judge also said the attorney general overstepped his authority by imposing the special conditions, agreeing with the citys argument that it was an attempt to usurp power from Congress over the countrys purse strings.
In a motion filed Sept. 26, Sessions asked Leinenweber to narrow the ruling to apply only to Chicago, arguing it would unfairly punish smaller cities that depend on the Edward Byrne Memorial Justice Assistance Grants.
But Leinenweber wrote in his decision Friday that the rule of law is undermined if he allowed Sessions to continue what is likely unconstitutional conduct in other cities while the lawsuit here is pending.
An injunction more restricted in scope would leave the Attorney General free to continue enforcing the likely invalid conditions against all other Byrne JAG applicants, the judge wrote.

Don’t send the money.
Enforcement of the law is irrelevant to irreparable harm due to conditions resulting from both prior mass disregard for the law and local continuing mass support for defiance of the law.
The judges argument is nothing less than circular logic.
The whole of the conditions begins with mass defiance of the law which has resulted in mass incidence of illegal employment of persons with no legal standing to be resident in Chicago, or Illinois, from which other employers have benefited to that illegality. The loss of the illegally employed persons will present conditions made by the mass illegality accepted and promoted locally. It would be harm brought on by the collective error of the state and city to be accepting of and promoting of illegal employment conditions. That consequence would NOT be a consequence of enforcing the law, but of the prior history and acceptance of illegality.

The blood and treasure of any American harmed by illegals is on their filthy, corrupt Anti-American hands.
You are correct that Congress needs to write this into law. No Federal funds to sanctuary jurisdictions.
Ding! Ding! We have a winner! It matters how appropriation laws are written. Some give broad powers to the Executive, some don't.
There's no doubt the Executive can enforce immigration laws and prosecute those who violate them. That would include mayors and city councilmen who conspire to violate immigration laws.

Note the use of the word “probably”. An eighty year old judge using the perfect weasel word.
Then it is time to start arresting sheriffs and police chiefs - and maybe some Mayors - for conspiring in the obstruction of justice.
