can someone lay out the legality on this option? Declaration of war by congress? War powers act of the president?

Don’t think it would take either one. We only agreed to a cease fire in 1953 and never formally lifted the UN “police action” resolution. We and the NORKS are still legally in a state of hostilities as co-belligerents.

The Korean war started in 1950, it was never declared over, it is well within the President's Constitutional purview to suspend the armistice and continue diplomacy by other means...
