Trump cannot be prevented from striking down Obama’s EO with his own EO.
If Obama wanted his DACA to withstand the test of time, he would have gotten Congress on board and had it pass legally binding legislation. He could have then used his pen for a legal act, signing that legislation into law. His E.O. wasn’t legal.
His E.O.s are not legally binding. They could have been challenged in court at any time. Nobody bothered.
