I understand the patient the cops were trying to obtain a blood sample from has a CDL. When I first got mine I was told according to NYS DMV regs, it may be the same in the rest of the US, anyone with a CDL involved in even a minor fender bender, let alone when a death is involved such as this case, could be automatically subjected to drug/alcohol testing. The nurse could’ve been arrested for obstructing justice? Even so the way that arrest was handled certainly stinks to high Heaven.
It seems that the other officers should have stepped up and asked the proper questions.
The Salt Lake PD may be acting as nice as possible so that the nurse will not sue them.
In any case, the detective owes everyone an explanation as to his actions.
>>Makes me kind of wonder why you have such an extreme problem with all cops. A great many cops are heroes, despite the actions of some.
Hero is such an overused term these days that it means nothing anymore. Most cops are government revenue agents. Some are scumbags, like this detective. SOME are heroes. But, even then, a hero is someone who acted heroic in a particular circumstance. It is not a career. A lot of heroes turn out to be bums who were just in the wrong place at the right time and they did what had to be done.
Even a bad cop can be a hero. Childlike worship of a uniform does not help anyone. It makes the bad cops feel more invincible because there are always some people who will assume the badge cannot do bad.
A cop is a government agent. As a conservative, we should look at them individually with healthy skepticism.
“Show me a hero, and I’ll prove he’s a bum” — Lt. Colonel Gregory “Pappy” Boyington, USMC
I definitely realize that some cops ARE bums, ref my tagline. That’s been there a while.
Just as every cop is a criminal
And all the sinners saints
Yep, and it's really strange that they even get started when ya see the magic words "I don't need a warrant" in the report.
It's not like prosecutors and judges keep their phone numbers secret from cops.
Any decent honest cop would have a cellphone as well as handcuffs, and a network of legal professionals that would obtain a warrant with the probable cause that the honest cop could deliver them verbally.
So why was a POLICE OFFICER trying to do a medical procedure?
How is he qualified and trained to do that and WHY was he trying?
Interesting quote by Pappy Boyington. I suppose he may have been referring in part to himself. He received a posthumous Medal Of Honor when he was, in fact, not dead but only captured. So he got the chance to reflect on the honor. And while he was an exceptional fighter pilot he was also a world class SOB. Roaring drunk that picked fights with random people just for fun. Hardly the prototype hollywood image of a war hero. Yet he was. And he was a bum too.
Last year the supreme court clarified when blood can/cannot be taken, based on their interpretation of the constitution. Acquiring a CDL cannot be predicated on giving up a portion if one’s rights. CDL holders arw protecred by the same cobstitution I am. Besides, how was the burse supposed to know rhis guy had a CDL.
A CDL operator can refuse the test. He then suffers the penalties. In this case the driver was unconcious and unable to decline.
Also, the cops new they were stepping over the line. I am sure they weighed the consequences and surmised if the blood draw was illegal the evidence would simply be thrown out. No muss no fuss.
The kicker is that the idiots arrested the nurse. Geniuses. That will solve the problem.
>>I definitely realize that some cops ARE bums, ref my tagline. Thats been there a while.
Then you should realize that they are ALL Charlottesville cops if that’s what they are told to do.
Yet, when they shoot a pet, they claim that they have a legal obligation to not retreat.
Individually, you have cops who commit specific acts of heroism. They are the hero of the moment and we’re damned glad they were there. But, hero is not an occupation. It is not a calling, and when you find a person who has a need to be called “hero”, you do not give them a badge and a gun. John Kerry was a guy who needed to be hero. JFK needed to be a hero. Vocational “heroes” get people killed.
Bingo!
Note to SLC taxpayers: It's soon going to suck to be you...
Especially if the DOJ gets involved. And, for once, it should.
He also said his time in Japanese captivity improved his health since he had no access to booze. Think about that one!
If I remember this right he was one of the first graduates with degree in aeronautical engineering. I think from Washington State or Oregon university.
All the cops know who the bad cops are within their respective organizations. They might hate what’s going on, but they protect them, anyhow. It’s that perverted code they have.
“The bad cop is still not in jail.”
Plus, he’s still drawing full pay.
We have more that our share of posters in the vein of Alaska Wolf on here.
Yes, but the way it works is the commercial driver is asked to consent, and may choose not to do so, enabling consequences and actions under the law and administrative rules. Those consequences would be regarding the Commercial License and probable cause to obtain a WARRANT to COMPEL a blood test.
The commercial driver was unconsious and could not give consent.
The copper could only compel a blood test if he obtained a warrant.
The apology would indicate a large penalty lawsuit is pending.
“...anyone with a CDL involved in even a minor fender bender...”
Does the victim have a CDL? I didn’t notice what kind of truck he was driving. Was it a commercial vehicle or just a regular ol’ truck?
So you think the cop was just enforcing federal law?
