Judge Richard Posner: ‘No value’ in studying the U.S. Constitution

Seventh Circuit Judge Richard Posner sees “absolutely no value” in studying the U.S. Constitution because “eighteenth-century guys” couldn’t have possibly foreseen the culture and technology of today.

In a recent op-ed for Slate, Judge Posner, a senior lecturer at the University of Chicago Law School, argued that the original Constitution, the Bill of Rights, and the post–Civil War amendments “do not speak to today.”

“I see absolutely no value to a judge of spending decades, years, months, weeks, day, hours, minutes, or seconds studying the Constitution, the history of its enactment, its amendments, and its implementation (across the centuries — well, just a little more than two centuries, and of course less for many of the amendments),” he wrote. “Eighteenth-century guys, however smart, could not foresee the culture, technology, etc., of the 21st century.”

This should be a mandatory question for everyone who requires confirmation to the federal judiciary - "Do you see value in studying the US Constitution in guiding your rulings, or do you simply make it up as you go along?"

There is always value in having a framework to guide the process of governing. Otherwise, it all becomes just a chaotic mess of on-the-fly, disconnected legislation that does not reinforce our basic values. And that’s what liberals don’t like or respect: ENDURING VALUES.

Actually, Judge Poseur (sp?), they could. They were students of history. They knew governments tended toward despotism. That's why they created a system with checks and balances.

They may not have been ables to foresee today's technology, but they damn well could foresee the culture.

This is self-incrimination as a domestic enemy of the Constitution. Immediate impeachment, in a sane world. Which this isn’t. You watch—this guy will soon be a big player in another anti-Trump drama. They wouldn’t be featuring him if he wasn’t one of the Cool Kids.
