Yes, if this was an unlawful arrest there could also be jail time for the detective.

If they did I would think that there would be another lawsuit coming over that civil rights violation.
And really in this day and age I am surprised that this ever came up. I would think that for a cop (particularly a detective) that it would be a no brainer that you can’t draw blood without consent or a warrant.
