I’m not saying the driver has no fault, of course, but braking and also being assaulted may go to his state of mind and intentions.... I haven’t studied all the photo and videos, but a driver’s panic reaction to a violent mob would be a different matter, both morally and legally, than a premeditated driving attack as it’s usually being described.
The single biggest point in the driver's favor is that everyone he hit was in the street. It doesn't mean it's OK to run them over, but it surely calls into question what his motivations were and what the culpability of the victims might be.
