Many confuse Assault with Battery
At Common Law, Assault is an intentional act by one person that creates an APPREHENSION in another of an imminent harmful or offensive contact.
An assault is carried out by a threat of bodily harm coupled with an apparent, present ability to cause the harm. It is both a crime and a tort and, therefore, may result in either criminal or civil liability.
At common law, Battery is an intentional un-permitted act causing harmful or offensive CONTACT with the “person” of another.
Assault is the threat of a harmful act, Battery is the harmful act itself.
An assault may have happened, but 68 years? Varsity level BS. Florida law classifies Simple Assault as a second degree misdemeanor, with penalties of up to 60 days in jail or 6 months probation, and a $500.00 fine. Aggravated Assault is classified as a third degree felony, punishable by up to 5 years imprisonment.
