Explaining Republican Inaction on Obamacare

Last Tuesday you were talking about Obamacare, indicated that, you know, passed by the Dems, how basically it was a shell. That the secretary of Health and Human Services then packed with mandates, exceptions, and exclusions. And I’m just wondering now that we have another, different secretary, why can’t he get in there and rip all that crap out of there?

[snip]RUSH: Now, okay, here’s the answer to the question. “Why can’t we just go in and start taking out of some of these essential health benefits that Obama put in there with his health and human service secretary?” We can but we haven’t gotten rid of the mandates yet. The law has to be changed to eliminate mandates. There’s three different kinds. There’s the employer mandate, the personal mandate, and then the Title I mandate: Essential health benefits.

We just can’t go in and rip these things out because they have occurred under a statutory Title I. It’s the way laws are titled and recorded. But that’s why there has to be a repeal, and the repeal goes in stages. Rather… If was it a full-fledged repeal, we could do anything we want. This is what’s frustrating about this. You know, Ben Sasse, the senator from Nebraska, just said, “Repeal it, and then during the August recess we come to work and we rebuild the health care plan.” I asked Ted Cruz about that. He said, “I would support this in a minute, but we’re not gonna get 50 Republican senators to agree to it. We can only lose two.”

Why in heck haven't Ryan or McConnell ever mentioned this instead of whining about how they are working to get some solution to Obamacare. The Affordable Care Act/Obamacare is legally bound up by design....that's how I read it rather than (McConnell argued that a smaller bill would have to focus on helping private insurance markets.)

Could it possibly be that McConnell/Ryan are not willing to assist this POTUS or Americans with the truth which is "The senator's comments indicate that Republicans may have to negotiate with Democrats over fixes for the health-care system.".....No, congress needs to legally extract Obamacare, illegally mandating American citizens from anything as per the U.S. Constitution, regardingthe "individual mandate".

Limbaugh missed the caller’s point. We’ve been told over and over that ACA delegates massive power to federal cabinet officers to set policy. Why can’t Trump’s appointees roll back the radical choices made by their predecessors? That will not cure the whole problem, but it is not a matter of law, but administrative fiat.

Exactly. My understanding is that the law is some 2500 pages but the regulations to support that law are sixty or a hundred thousand pages with more being written every day up until Obama left office.

So, why can’t we use the same pen that wrote the regs to simply re-write the regs? Or erase them? That might not fix all the problems but it would go a long way. For me, the hundred thousand pages of regs *are* the problem.

This is exactly how I predict ObamaCare will meet its ultimate demise. If the Republicans in Congress can't get their act together, the HHS Secretary will simply issue waivers for any and all health plans that any insurance company is willing to sell -- even if they don't meet any of the requirements of ObamaCare.

Because as Cruz told Limbaugh in the piece, dealing with just reversing the regulations is pointless. The next Democrat administration will just put them all back in because the mandates that give rise to the regulations are still in place by the law itself. You have to rip the entire law out, and that way there are no regulations that have any basis. You have to do both. That’s what Cruz is saying is impossible when you have GOP neurotics in sheer panic of bad liberal press and no fundraising. Lest we forget, the left buys insurance by financing a lot of GOP senators. The scare Republicans are not going to bite the hand that feeds their political careers.

Absolutely true.

The politicians in the GOP are professional liars who con voters into supporting and voting for them. But they are nothing more than purveyors of BS and empty rhetoric.

Its all about them, not us. People need to think about that before they vote for these charlatans next time and need to remember the old adage: Fool me once, shame on you. Fool me twice, shame on me.

That worthless a$$hole Pat Toomey, when asked why they had no waiting legislation to repeal and replace Obamacare, said that “they didn’t really think Donald Trump was going to win!” There are not even a handful of the GOP Senators that are worth two hoots in Hell! Lazy bastards all of them!

That needs to be fully exposed in next year’s Senatorial Elections. We need not only to capture a number of the open RAT seats, but we need to do some replacements of most of the GOP that are also running. Who among this list of eight are worthy of re-election?

They opposed President Trump because they NEVER intended to repeal or replace, they just wasted time and money on appearing to knowing Obama would veto.

The Cruz amendment, if I understand it correctly, is perfect for RINO-coward leadership like McConnell and company.

The amendment states that as long as an insurance company offers at least one Obamacare-compliant plan, it is free to offer any other type of plan (i.e., private sector?).

This would kill off obamacare in short order, without having to repeal it.

Or did I miss something... chime in.

Administrative law you say? Try the pages no one read, still have not read- and voted on. “Simple solution-Vote no to Obamacare and yes to free market plus all other solutions as Congress may pass and the Pres may sign into LAW.” DA END.

Time to PRIMARY the whole lot or hold nose and vote D.
All of them ran on campaigns to shut this crap down.
It ‘worked’ for them as long as the #s were close and a D was in charge.
That these asswipes have the gonads to make a statement admitting there was NO PLAN, just shows how much disdain ‘they’ have for US.

We can’t be much worse off with the Ds OFFICIALLY in charge.

They are running/controlling things now.

The ONLY way to get them on board is to declare ALL be in the same program ‘they’ have foisted upon us.

PERIOD.

Military hospitals are for the Military.

Let the Senators/Representatives/staffs/unions etc etc live under the same ‘rules’ as us commoners

I agree with you; which is why I suggested the Cruz amendment allows cowardly RINO leadership to leave obamacare in place, which I expect they will do, but perhaps passing the amendment, which allows most common-sense thinking citizens to choose a private plan.

I too wish obamacare would be fully repealed, but McConnell does not have the guts to do it.
