The indictment or criminal prosecution of a sitting President would unconstitutionally undermine the capacity of the executive branch to perform its constitutionally assigned functions. -- DOJ opinion, October 16, 2000
The Department of Justice has long held that it would be unconstitutional to criminally charge and prosecute a sitting president. The Constitution itself expressly states that indictment, trial, judgment and punishment can occur only after a president is convicted upon impeachment (Article 1, Section 3).
However, there is nothing to prevent a special counsel from investigating a president and leveling an accusation with no formal charge. The accusation could be completely manufactured and meritless. Proving it in a court of law would be irrelevant because impeachment is a political act, not a legal one.
A similar scenario has played out before. Independent Counsel Ken Starr investigated President Bill Clinton and leveled accusations of obstruction and perjury which then triggered Clintons impeachment. After he was acquitted and left office, Clinton was never indicted because prosecutors knew the case lacked the kind of proof needed in court.
So, is this what special counsel Robert Mueller and fired FBI Director James Comey have in mind? Are they now acting in concert to conjure a case of obstruction where none exists for the sole purpose of precipitating possible impeachment proceedings? There is nothing to stop them from doing it.
It is a legitimate question, given their cozy relationship. They also have a motive to harm President Trump retaliation for the firing of Comey.

Bump!
Though I was furious with Levin for not endorsing Donald Trump till September, he has been presenting some very good information regarding what has been going on regarding the investigations, Mueller, and the fact that a President cannot be indicted—so Meuller would be doing this for impeachment...and Meuller should recuse himself.
Not sure if you caught it, but here is a Sean Hannity segment on the topic.

Hannity, Jarrett, and even Levin have really been delving into this...
Really something that even some Fox talking heads think having Mueller investigate is great idea :(
Thanks, I hadn’t see that.
Good segment by Levin on Hannity, those two and Jarrett as well as a few others have got it right on the witch hunt that’s been taking place.
There’s been a number of RINOs sitting back and saying nothing, very telling.
Agreed. In addition, Circa News’ Sara Carter and John Solomon, Laura Ingraham and Judicial Watch have all been on this...often on Hannity’s TV or radio program...
Hope they all have good security and people praying for them!
B$ They didn't indict because they didn't want to, any more than the Senate wanted to impeach. In fact the Senate wouldn't even let the House present their case.
The senile old Chief Justice had no clue what his role was in fact the Parliamentarian was the final arbiter on almost everything of importance.
Of course it will, exactly as the Deep State planned. It all began when Sessions kept his number two and recused himself. No tinfoil required to believe that whether he was complicit or naive the result is the same.
The fact that there has been nothing of importance come from Sessions except a threat to withhold federal money from sanctuary cities/states, instead of threatening to prosecute those clearly violating the law.
Does anyone remember when Mitch was asked how they would deal with a runaway President like Trump? He declare they had ways to do it that they never used against the runaway Obama.
Is it possible the Republicans in the House are giving Democrats enough rope to hang themselves?
They could possibly lose much much more than their positions if they back stab our duly elected President. I think there would be an uprising bigger than anything this country has seen before.
It could end very badly for a lot of bad actors including mueller and his henchmen lawyers. It might even be something as bad as what Chris Stevens went through in Benghazi.
Right now the American people are watching to see how far these corrupt leftists will take this farce. If they cross the line they should be prepared for the consequences of their actions.
