Liberal deity avoids taxes by using loophole created by Donald Trump

Then he used a tax loophole created by Donald Trump himself back in the 1970s, when the current president was merely a prominent New York real estate developer and aspiring celebrity author.
Trump didn’t create the loophole, he wasn’t in office.
Trump EXPLOITED the loophole.
The legislature and executive has had 40 years to close the loophole if they saw fit.
They did not see fit.
How did Trump create a tax loophole? Was he writing legislation?
