Foreigners here legally are subject to the jurisdiction of the laws. Those whose parents are Illegals are not to be citizens. So, if the parent is here with the express permission of the US a baby could be a citizen since his parents were under the jurisdiction of the law.

Apparently the “Exceptions Clause” gives Congress the ability to limit the courts.

Article 3, Section 2 - “In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such EXCEPTIONS, and under such Regulations as the Congress shall make.”

According to some legal minds (me) this means Congress could tell the Ninth Circuit it cannot rule on something.

The kicker for me was the dem lawyer admitting that anyone else giving the same order would be fine. The judge indicates it was “the statement” that the dems are building their case on. “The statement” was Trump saying “you know what that means”.

Apparently he said that when issuing either the first or 2nd order. The dems say he meant “we’re gonna get them muslims” and not “we’re concerned with security.”

Evidently this entire case is built on that bit of mind reading.

“Jurisdiction of the laws” does not mean that Illegals can’t be prosecuted for violations. It just means, in that case, that they were born under another jurisdiction though within this country.

Regardless of the jurisdiction at birth, if they aren't under US jurisdiction they aren't subject to US laws.

Jurisdiction is largely a matter of geography. If you move, the jurisdiction changes. It doesn't matter where you were born, it matters where you are (or where you were when the act in question occurred.)

Seems to me from all their talk that they are deciding this on the basis of their opinion on what Trump meant by “you know what I mean” when he signed it.

Most of them don’t think the words of the law matter one iota. Or the nationality of the person.

LOL they're making up their own law as they go along. Maybe this is what Trump was hoping for? It would take a little while, but hopefully set precedent, in effect telling judges they cannot meddle in foreign affairs.

There would have been no such clause in the Fourteenth amendment if jurisdiction has no real meaning. Foreigners legal and illegal are still subject to the laws.

Nonetheless, it’s best to predict the norm. They will vote party line, so they will go against Trump. They are political appointments, and this is a high profile democrat case.

If the court buys that, then they are saying that all politicians speak the truth and all of their campaign promises are fulfilled.

This will open up a lot more lawsuits for all politicians based on their promises- “if you like your doctor/plan, you can keep them”, “save $2500 a year”, ...
