Murder seems like an over charge. I doubt this officer intended to kill the young man. Negligent homicide maybe.
All the officer has to say is "I didn't intend to kill him"...and he'll get off like Susan Rice, Hillary and Huma.

That's the game! DA's over charge and know that their law enforcement buddies will skate and the jury will be blamed.
This poor cop was a mess, had been suspended before, and had no business on the beat. His superiors should be fired. But, they won't be.
One might make a case if the officer fired into the tires.

He did not go on duty to chalk up any kills.
When the incident went down he was not after this particular young man.
But, firing your gun at a car with people, with some intention to stop whatever is happening, you do intend to hit someone. And you cannot plan to ‘wound’ them versus killing them. Or shoot the tires out, or put a magnum slug into the engine block.
So any gunfire contains the strong possibility of killing someone.
