I bet the money will be added on to the ticket of every person flying, for the foreseeable future. WE are the ones who will be paying, even if we don’t use United anymore.. if United raises their fares, so will every other airline.

Once this guy was informed by United that he would not be allowed to fly on their plane, he needed to vacate the plane.

My guess is they told him they would fly him on another airline. He gets to the counter and finds out they knew this was the last flight out for the day. He believes they lied to him and he goes back and takes his seat.

So instead of dealing with him honestly and trying to take into account that he has some special circumstances they bait and switch. The guy has a pretty good case. If I were United I would pay about 3 million plus hospital bills to make this go away and get the victim to sign a non-disclosure on the amount of the settlement.

How long do you think they want his lawyers complaining to the press about their tactics to absolve themselves from any responsibility? United certainly does not want to go before a Jury with the video evidence available so far.

“...trespassing has nothing to do with it. A ticket is a license, similar to a tenancy, in that it confers a right to be on someone else’s property for a limited time and purpose. Had he not paid and been granted a license to be there, it could be trespass, but since he did and was, that isn’t an issue. There is no trespassing component to this at all. It’s just a matter of contract.”

Completely different situation! You didn’t buy a ticket to eat. The purchase of an airline ticket comes with a whole host of regulations (it’s a contract). It will be interesting to see how UAL deals with “their regulations” in court.

I've seen reports this morning that the guy who took the video was claiming the airline did nothing wrong. If that's the case, the video could do as much damage to Dao's case as it does to United.

1. You are likely correct about the settlement being a quiet one. I have to ask about the “insurance carrier”...do you refer to the travel insurance typically offered that I typically decline? What other insurer would be involved?

2. Dao may have decided to never fly United again, anyway. As many of us have already done, based on similar, albeit less extreme treatment by the carrier.

If they lied to him and he took some step reasonably relying on their lie, then he could seek damages resulting from that particular aspect.

But he should not have the right to any damages relating specifically to his forcible removal from their airplane after refusing to leave when told repeatedly and at length that his ticket was cancelled and that he no longer had permission to be on their airplane.

the lawyer is claiming that noone has a right to forcibly remove anyone- apparently this moron thinks that someone screaming religious rhetoric of islam and being violent is allowed to do so and can’t be forcibly removed because ‘he/she has rights’

1. United will file a counterclaim against Dao specifically to get his own insurance carrier involved. If he has an umbrella liability policy under his homeowners insurance they would likely be dragged into it. His own professional liability insurance may come into play here, too -- since he identified himself as a doctor and claimed that he couldn't get off the plane because he had patients to see the next day.

2. I agree. I was responding to the prior comment where it was suggested that he'd get first-class seating on United for the rest of his life as part of a settlement.

Another feel good action for an attorney to make some money. All passengers sign an understanding of the passenger policies to get on the flight. What they did was within the law. But no one wants to go to court without guaranteed money. So a class action suit for all the bumped people that took retribution money, or flights, or both, can’t recover anything. And this passenger in violation of what he signed, wa stupid enough to get recorded telling police he would have to be dragged off the plane. He should be nailed for court costs and told hows stupid he really is.

you left out the part of the contract that states that the contract can become void for any reason- He was bumped from the flight- He then is no longer under contract-

When I watched another video posted on a foreign news website, one item from it really jumped out at me. Dao clearly makes the following statement to the aviation police who are there to remove him:

"You can drag me then, I don’t go. I'm staying. You'll have to drag me."

This is where he exposes himself to a counterclaim in any lawsuit. It's called contributing to the harm that you claim someone else has caused. I'm sure his lawyers already know the potential risk of filing a lawsuit against defendants who did exactly what the plaintiff told them to do.

United created the environment that allowed this event to take place.........Specifically, they deliberately over booked. Doesn't matter what the disclaimer on the ticket says, that's just legal gobbly gook.

A lawsuit will take place and the attorney will convince the jury that nobody who advanced booked a seat on a plane, was allowed to enter the plane and take his seat and posed absolutely no threat or danger to any individual on that plane should be dragged off that plane, receive a broken nose, two front teeth knocked out and a concussion.

United doesn't stand a chance in hell in defending the beat down 69 year old Dr. Dao received. So the question isn't whether or not Dr. Dao will win the suit but how much will the settlement be and how will it affect the entire airline industry and their habit of overbooking........

The attorney is playing United like a fiddle. Every day this stays in the news is millions in lost revenue to United.

The quicker United settles the faster they stop bleeding.

Interesting you brought up Munoz’s compensation. I read this morning that he was due for his annual bonus, which was somewhere around 12-13 million dollars. I wish I could remember the article...it was a business journal. At any rate, the journal suggested they postpone that big bonus announcement for awhile.

United did not bust his face, airport cops did.

United is guilty of overbooking.
Airport cops are guilty of beating him up.

If I was on the jury I would vote in favor of United.

United's stock took a hit in recent days, but they're still trading within 10% of their 52-week high. I haven't seen any evidence of United flying half-empty aircraft around the country, either. That scenario is not likely to play out when you've got the entire industry trying to operate at 110% of their seating capacity at any given time.

The whole industry is awful, and this is going to shine a bright spotlight on business practices that any normal business owner would find repulsive.
