New York City can destroy personal documents associated with its municipal identification program, a judge ruled Friday in a victory for city officials who have sought to protect cardholders from possible deportation.
Republican state Assembly members Ronald Castorina Jr. and Nicole Malliotakis filed a lawsuit in December seeking to prevent the destruction of documents, such as copies of foreign passports, used to verify a persons identity to obtain the IDNYC card.
Justice Philip G. Minardo of State Supreme Court on Staten Island ruled against the lawmakers but issued a stay Friday until April 17, pending an appeal.

I take a different view on this. NY State’s, county and city records are their own property. As such, they are the property owner and unless they are subject to a warrant, then the documents can be disposed of how they see fit. The files are NOT in the public domain.
However, if the files SHOW that the person is here illegally. Then there is a federal felony being executed by the state. Not sure how you could, from the lack of documents, show that the state knew there was a crime being committed.

In the next 5-10 years there will be a landmark Supreme Court case about local jurisdictions responsibility to the Feds regarding Imigration status. Basically is a Santuary City legal.yes there is president bout Fed law, like integrating schools in AL in 1960s, the JFK vs. George Wllace stand off but it will work its way thru the court of the tune to Jose vs. USA where the other question to solve is what constitutional rights does an illegal have? Are constitutional rigs for Citzens, or humans standing on US soil?
We need to stack the court now. Good first start yesterday and with Senate rules nuked, getting solid judges on the bench got a lot easier.
Need to work every election campaign from now on.
