Gorsuch’s pro-illegal immigrant ruling roils confirmation debate

Judge Neil Gorsuch repeatedly defended an “undocumented immigrant” against the massive crush of the administrative state during his confirmation hearing Tuesday, picking a fascinating fight with his potential future colleagues on the Supreme Court. The case he was referring to — a 2016 ruling from the 10th U.S. Circuit Court of Appeals, in which he wrote both the opinion of the court and, strikingly, a separate concurring opinion — has become a major flash point in his quest to win a seat on the Supreme Court.

If there’s a ‘massive crush of the administrative state’ why are there so many illegals swarming the US?

This issue can be played both ways.

He backed the law in his ruling, but criticized it in his writing.

Non-issue in the big picture.

Dems don’t have the guts to filibuster him and he’ll get 60 plus votes.

Generally, this is the way the courts are supposed to work. Defer to elected officials & the people they put in place. It’s pretty convoluted, reminding us that “hard cases make bad law”.

At that level, it’s not unusual to see “strange bedfellows” cases. That the defendant was an illegal immigrant doesn’t mean the case favored illegal immigration; actual abuse of law cannot stand, and due process applies even for eviction. We’d have to know the point of the actual case, not hyperventilate over the defendant’s status.

Probably the administrative state was pile-driving this one defendant, instead of spreading efforts among many more illegals.

The establishment fix was in for Gorsuch a long time ago. He's the supposed replacement for Scalia but doesn't seem near as culturally conservative which means that the left gets what the want.

The next candidate is going to be so far left by the time it's done because that's going to the establishment demand.

And by establishment I mean republican and democrat

I watched the hearing. I was disturbed by Gorsuch's use of the term "undocumented immigrant" and his apology for using the word "alien" and quickly correcting himself to replace it with immigrant. The legal term is unauthorized alien.

The Reps have a history of nominating "conservative" justices only to see them become liberals. The Dems never miss with their nominations. The always remain liberal and vote as planned.

I have an uneasy feeling about Gorsuch. He could become another O'Connor or Kennedy or Souter.

Watched a bit yesterday. The nominee is an obsequious, puffed up prig. He’s gonna be another “evolving” ‘Pub (dis)appointment.

The hypocrisy of the Demonirats (matched only by their pursuit of murder and treason) was demonstrated in the hearings concerning Judge Gorsuch's defense of an "undocument immigrant" (the PC euphemism for "illegal alien"). Even though Demonicrat Feinstein had expressed concern whether Gorsuch cared about "the little guy" in his decisions, the Demonicrats (e.g., POS Franken) opposed Gorsuch's support of the individual.

If Gosuch had said "up" (or "down"), the Demonicrats would complain he should have said "down" (or "up").

The reason why liberal judges stay liberal and some conservative judges turn liberal is so very obvious, actually.

Liberal judges tend to be activist judges, which essentially means they are wielding more power personally as activist judges. Power is very seductive, and judicial self-restraint is very difficult.

Same feeling I got. This guy seems to have been moving toward a moderate stance. I did not get the felling his ruling on travel “ban” would be a sure thing.

What is more concerning is Gorsuch’s blank slate on abortion. From some of his answers to the Democrat abortion senators, he hints that somewhere this “strict constructionist” has found in the Constitution the right to kill your baby till the day of its birth. He emphasized that the right to abortion is “super precedence.”

Conservatives are haunted by the history of Republican presidents who gave us liberal activist SOTUS justices such as Warren, Souter, Kennedy, and Roberts. Not a good record at all.

He was personally a conservative..but he was an originalist.

Some outcomes were not conservative

Bad news. This is a guy who views the power of the court to make bad law more important than overturning the power of the state to murder it’s citizens.
