Judges’ ‘Twilight Zone’ logic in slapping Trump’s travel ban

It’s not my purpose here to question the patriotism of the vast majority of America’s Muslims. Or to deny the excruciating predicament in which they’ve been put by our common enemies operating in the name of Islam.

What dimension, though, are these judges living in? Their orders are totally detached from what the framers of the Constitution meant when they prohibited Congress from making any law “respecting an establishment of religion.”

Why did the Founders word it that way? History suggests their aim was not to separate religion and state. It was, rather, to prevent Congress from enacting a national religion while also protecting already enacted religious establishments — official religions — at the state level.

At least six states had established religions in our early years, according to the Heritage Foundation. This finally came to an end in 1819, when Massachusetts disestablished the Congregationalist church.

Our judges have long since plunged past original intent on religious establishment. But the Founders would have been aghast at the idea that the Establishment Clause prohibited, say, a president from vetting refugees to intercept terrorists.

We can suppose this because of what happened in 1785, when a group of Algerians hailing from the Barbary Coast, with whose pirates America was in effect at war, entered Virginia. The Commonwealth’s legal sticklers passed a law authorizing the governor to hold, question and expel them.

On a purely objective basis, the grounds on which these liberal judges chose to reject the now TWO Executive Orders has no foundation whatsoever. Uniformly, they have relied on the possibility that the order MAY have been a blanket ban on Muslims, because of a statement that Trump as a candidate made over a year ago, and not on the question of whether the right to make such a ban is Constitutional.

A decision WAY beyond their pay grade.

Someone should ask the Judge that since the president does have the constitutional power for such a travel ban, but the judge’s contention be that it is “discriminating” against a certain particular group, then would the judge agree that a ban on ALL TRAVEL FROM ALL COUNTRIES TO THE UNITES STATES would just be HUNKY DORY A-OK?????

Trump should publicly go “King Solomon” on this pathetic Judge!

I would love to see Trump send all the Syrian unvetted refugees to Hawaii. Let the Hawaii tourism take the hit when people have to decide if Syrians pose a threat to Hawaii from potential terrorism.

Let people from all over the world know Hawaii is vulnerable because Leftist Judges who don’t have the Presidential daily threat breifings decide not to allow him to keep America safe.

Let Hawaii go without tourists let them learn that These Muslims may pose the threat Trump said they do.

I know many Americans won’t risk their life to go to Hawaii.

HOW CAN THE COURTS STOP A CONSTITUTIONAL POWER OF THE EXEC. BRANCH AT ALL? It should be laughed at and ignored.

In the Maryland case the plaintiff, a Muslim resident alien, claimed her religious rights were violated by denying entry to her relative, also Muslim.

Clearly this ruling means any foreign national enjoys constitutional protections if they have a relative legally residing in the US. Let that sink in for a minute and think about the broader implications.

The appeal would be up to the Supreme Court now if we had Judge Neil Gorsuch confirmed and on the court.

I’d say pursue these judges smuggling illegals and terrorists on Federal
RIcO charges. They are not above the law.

The government should not undermine our citizenship by smuggling terror for its own registration ends

Under 8 USC 1152 (f) the President can ban entire classes of people from entering the country. Intent is not an element of the statute. Nor is there language about religion in the EO.

To base the ruling on statements made in the past and worse yet, by Rudy, is absurd.

Basically, it doesn’t matter what he said. The statute gives the President virtually unfettered discretion.

How the Constitution gets into it is a mystery to me. Foreign nationals on foreign soil have no Constitutional rights.

Well, seeing as two of the three prototypes crashed killing their pilots, (one while performing a demonstration flight in South Korea, the other while practicing for a demonstration flight at the Paris Air Show,) combined with the elimination by the Reagan Administration of the Carter-era export restrictions on the F-16, it's not surprising that no third world tinpot dictators wanted to buy the F-20.

The crashes were not because the airplane had any inherent flaws, they were because the airplane's performance exceeded even the highly-trained test pilots' G-tolerance.

President Trump has a DUTY to the Law to specifically ENFORCE IT when others patently and OBVIOUSLY dismiss it. He FAILS in this duty when he acts as though the rogue courts aren’t going rogue.
