Democrats tend to love sneaky lawyer tricks because their side is so good at them. The passage of Obamacare under the Senate rules governing reconciliation is the most prominent example of creatively applying the rules to get what they want.
But it turns out that there are some really smart and creative legal minds on the GOP side, and now that the GOP runs the Senate, the sauce for the Democrat goose also flavors the Republican gander, if that isnt too disagreeable an abuse of metaphorical license. Ted Cruz is one such legal mind; in the words of legendary Harvard Law School Professor Alan Dershowitz,

Cruz is not pursuing repeal. He’s pursuing a reconciliation process.
Cruz will get a few Hoorahs for today. Years out people will be saying WTF? because he’s showing a path that the democrats will use in the future.
I’ll say it again. The republicans are stupid. Under the umbrage of President Trump, they can appear smart temporarily and we can all enjoy that. But the establishment will never change until people force them out. That’s a fact. That means the republicans will still retain genetic stupidity meaning they never learn to turn the nation back to its founding principles which are sound and valid.
The democrats are criminal and will remain criminal. They are smarter than the republicans because they LEARN how to tell new lies that the stupid party falls for.
Let Cruz do today what he thinks is smart. But most will see in the years hence that he was reckless. And he is reckless. That’s his weakness. As other Freepers have posted about him, he’s too smart by half.
McConnell can put the Obamcare REPEAL on the backburner while the President gets tough and sends Sessions after the democrat criminals. Then he gains leverage on the 60 votes.
That’s hardball. It needs to be done.

Exactly- the dems WILL do this in the future- so republicans would do well to strike preemptively on this instead of doing what they always do, tuck tail and let the dems walk all over them because rinos ‘don’t want to sink to the level of the dems’ nonsense!

And boy are you right, though my wife is 6 years out from cancer, the preventative treatments (since she’s had it three times) are costing us THOUSANDS this year.

And yes, she is doing great and the stage III cancer she beat 25 years ago. The recent ones were stage I and II.
I am very optimistic.
Trump needs to back off his stubborn pro Ryan-care position, and listen to Paul, Jorden, and Lee.
Democrat criminals from blue states will just get replaced with other Democrats.
You got 52 votes. 7 less than Reid had. You may never have any more. Ryan is right. This is the closest we’ll get.

Somebody clue me in: If the 60 vote is the rule for the Senate yet it is not in the Constitution. What or who decides that it has to be 60 votes to pass it?

Paul Jorden and Lee? Lee tried to backstab Trump every second of the campaign. Why should have any say in anything?

A filibuster is dependent upon the floor being open. The maneuver blocks the filibuster on a point of order: The floor would not be open.

The 60 vote rule is a Senate rule. It’s what’s required for cloture (what ending a filibuster is called). It protects the rights of a minority of substantial number from overreach by a majority.
There is some question as to whether or not it takes 60 votes to undo that rule. That probably doesn’t matter because there are plenty of conservative GOP senators who would not approve of an attempt to undo it, so even 50 votes are not likely.
These are the rules. The Dems had single payer healthcare thwarted by them. We have the 60 vote rule to THANK for sparing us from Obamacare being a Canada style NHS rather than the multipayer plan it is.
Politics is the art of the possible. Only Reconciliation is possible. We don’t have 60 votes to do more.
This was already shot down. Everyone knows it’s just trying to deprive the minority of the filibuster. Plenty of conservative Senators will not approve of a backdoor killing of the filibuster.

I see your relentless attacks on folks who are AGAINST RYANCARE and it is easy to see your intentions revealed by what you’re attacking. And you are putting a great deal of time and effort into your campaign to try to discredit those Ryan Care opponents.
thats’ great news- they are doing tons with cancer now- I had a recent scare after having pneumonia- there wer spots left on the lungs- docs thoguh it was cancer- I came very close to havign 2/3 of lung taken out- but I asked for a biopsy doen first- just to be sure it was cancer- turns otu there was no sign of cancer cells- and several biopsie samples were taken- Doc was surprised- I was relieved- but they still don’t know what caused the spots- still have a little left- but it’s almost gone now 1 year later-
but it took a few months of testing- it was draining just worrying those months- can’t imagine how draining it must have been for you and your wife to go through having it- Must have been awful
During that time I researched cancer and treatments- and learned even small cell cancers aren’t the horror they used to be- There have been huge advances in treatments-
So did Cruz during the primaries and the election.

The only thing keeping the republic from rolling over into a mob-ruled democracy is the 60 vote rule.
If it hadn’t been for the 60-vote rule, single payer universal healthcare would have been passed by Pelosi in 2009.
So it works both ways.
The 60 vote rule is more than 200 years old. It defines the Senate, otherwise with the 17th Amendment, what’s the point in having a Senate?

Congress will never propose such an amendment as the above. That is why George Washington’s friend and fellow Virginian made sure the states could propose it without Congress.
When the incredibly poor judgment behind the 17th Amendment was in control, part of the basis for its proposal was that the Senate had always had the 60-vote rule. And here we are today thinking well let’s get rid of it! That results in losing the republic to a mob.
Ryan is for using reconciliation tactics, not repeal.
Cruz is for blowing up Senate rules to use reconciliation, not repeal.
I am for repeal.
Bottom line is Congress does not hold the cards for repeal. President Trump holds the repeal cards but he will have to direct AG Sessions to play hardball with criminal democrats. That will clear the way for 60 votes and a repeal, not a temporary reconciliation.
If you take away anything, take away knowledge of the difference between ‘reconciliation’ and ‘repeal’.

I wonder if there is another bill all ready siting in reserve to be presented when everyone uses there political capital to end this bill. at this point trump and Ryan are getting the never trumpers to say that this bill is bad and getting them to state what needs to be done. I think what ever bill trump and his allies in congress brought fourth was going to get attacked by McCain and his allies. after this bill fails a new more fiscally conservative bill can be put forward with those on the republican side being forced to except it because it addresses the biggest criticisms they brought up.
of course I am probably grasping at straws looking for an explanation for the mess witch is this bill.

Doctors are sometimes more dangerous than the illness! Even at the “best” places we have in NYC.
It must have been VERY draining. I remember waiting only 5 days for test results on possible colon cancer polyp, 30 percent chance, it was negative.
Months, that’s brutal.
