Bingo! CO2 is a naturally occurring trace gas, not a pollutant. I can’t believe Ocarter got away with “deeming” CO2 as a “pollutant”. This allowed them to regulate all sorts of things they had no business doing.
I remember that the US SC ruled, in a 5-4 decision that carbon dioxide was a pollutant that could be regulated by the EPA. The case was Massachusetts vs. EPA, 2007.
