No, if there are Americans to fill the jobs, then H1B visas are not issued.
The USA mindlessly issues 65,000 H-1B visas every year, like clock work.
There are many, many ways to get around that. I learned all about that in 2002, when I and many other American IT workers were laid off during the 2002 IT slump and over a quarter-million H1-B visas were still issued.
But the company-supplied definition of “Americans to fill the jobs” for each of their particular jobs is the heart of the now decades-long H1-B visa scam. Recall Disney and more recently UCSF having their existing I.T. people train their Indian H1-B replacements.
Making it “merit based” should eliminate around 70% of the H1B holders who currently come.
If it were being run honestly. Obviously that has not been the case, since companies like Disney brought in H1B visa workers to replace Americans who were already doing the job.
Shutting down the H1B visa program must be accompanied by other moves to prevent simply offshoring the work. Tech export restrictions, taxes equal to the difference in prevailing wages, etc.
