Army Sgt. Bowe Bergdahl walked away from his post without permission or orders to do so, in Afghanistan in 2009. He spent 5 years as a prisoner of the Taliban until May 2014 when President Obama traded 5 Taliban prisoners for him. Since being back in the US, he has been awaiting court martial on charges of desertion and misbehavior before the enemy.
During the campaign, Trump referred to Bergdahl as a traitor. And Bergdahls defense tried to argue that it threatens their clients chance at a fair trial. That argument was thrown out this past Friday by Judge, Army Col. Jeffery Nance. The judge stated that although Trumps remarks were disturbing and disappointing, they were not a threat to Bergdahls due process rights to a fair trial.
He continued by saying: The accused was merely the foil for delivering that political message. All reasonable members of the public and potential panel members will know that was what he was doing and will not allow the rhetoric to affect their impartiality.
Did Bergdahl desert? It wont be long before the trial begins and the truth can begin to unfold. Until then, his defense team cannot use campaign remarks to get the charges dismissed.

Just reading up on it a bit. If he appeals, it will go to the Army Court of Criminal Appeals which will review the case for legal error, factual sufficiency, and sentence appropriateness. After that it would go to the Court of Appeals for the Armed Forces, which under Article 67(c), the Court’s review is limited to issues of law. Only after that would it have the potential to go to the USSC, which from what I read, is a very rare occurrence. All that being said, that sorry sack of $h!t is lucky he wont be put up against a wall. It’s what he deserves, but it will not be what he gets.
Let me see if I understand this right... Trump calling a traitor a traitor is potentially (in the defense’s view) prejudicial, yet Obama’s welcoming him to the White House as a hero is not?
You can’t have it both ways. If you want to act as a political pawn, you are part of the political sphere. Trump gave his opinion, and that’s all it is, an opinion, not a policy.
That's a completely valid point to make.However,I believe that appeals courts are more sensitive to "bias" (my word) that could *increase* a defendant's chances of being convicted,not one that *decreases* the chances.
I'm no lawyer and have no experience in either civilian or military law so someone who *has* such training/experience may well disagree.

The Chain of Command starts with Trump. A few weeks ago it started with Obama. Big difference.
If the defendant goes to a newspaper and does an interview, saying, for example, that he killed someone, he can’t later demand a change of venue because people think he killed someone.
In this case, the defendant, knowing the totality of the circumstances of his actions, chose to go to the White House and have the president speak on his behalf as well as making his own comments. Such actions invite commentary, and of course, commentary can reasonably be anything (I think he’s innocent, I think he’s a traitor, I think he’s a moron, etc.)

Well many want him released so they can make their own Justice happen. His action resulted in a couple of deaths of his fellow platoon members.
If he had any clues, he should want to stay in jail as long as possible for protection.But he is actually clueless.
