Again, I would not advise citing the Declaration of Independence to a person who is answering to a charge of Sedition.

The courts are not the arbiters of the Constitution, the people are through their representatives in Congress. When law is made up out of whole cloth by the courts the people have the right to set things straight using civil disobedience and outright rebellion if necessary - it's not necessarily my opinion, that is the opinion of the founders of our country (and the authors of the US Constitution.)
