Apart from the unremitting attacks on Republicans by paid mobs and Democratic congressmen desperate to help the base forget they lost big time and will continue to do so in 2018, the big news this week has to be the Ninth Circuit Court of Appeals granting itself the right to dictate foreign policy despite the clear words of the Constitution and federal law granting the president the absolute right to preclude entry to any alien he thinks poses a threat to national security.
Following a nonsensical decision by federal court Judge James Robart in Washington state staying the suspension of entry from seven countries, the administration sought to overturn it -- the most popular Trump executive order -- in the Ninth Circuit, the largest and most frequently overturned federal Circuit Court.
In the meantime, the Department of State is bringing in refugees at a furious rate:
1,618 have come in since Trump first signed an EO to pause the refugee program for 120-days -- and less than a week since Judge Robart ruled on a portion of the EO.
Of the 1,618, the following came from countries the Administration was particularly concerned about. And, remember, although there were 7 countries of concern (90 day pause from 6 of them) Syria was to be halted indefinitely:
Iran (84)
Iraq (151)
Somalia (68)
Sudan (24)
Syria (248)
No refugees came from Libya or Yemen, however, 78 came from Afghanistan in less than a week -- a country I maintain should have been included from day one. (This notion that the 7 countries targeted had already been identified by the Obama Administration so, we are told, the Trump team thought they had some sort of PR coup with the media was a dumb idea. The media hardly mentioned it.)

If the judges fail to follow the law, arrest them. Especially if they violate the Constitution. No more of this flouting the law like Obama’s administration did. Let them know the “lawless” period is over and won’t fly anymore. They aren’t above the law. Judges like this are the reason Trump was elected.
They didn’t rule on the constitutionality of the law so they broke no law in that respect.
They took the weakest argument, that not allowing them in hurt Washington state etc which is still BS but had the EO been written better this would have been no problem.
You allow wiggle room and snakes and rats will find a way.
I expect the next EO to resolve the issue.
IMO the increasing number of Musliareas intentional. I would imagine they are most likely being brought in to form an ISIS type army here on U.S. to stage a coup against the Trump administration and remove him fom office . In the past I would have looked at someone who said something like this and thought they were a conspiracy nut. But not after the past 8 years. EVERYTHING has changed.
It’s no joke. If you accept the premise of the 9th Court’s “authority” how long before they declare that the countries targeted by the US miliatary are disproportionally muslim and that the President is accordingly engaging in systemic religious discrimination.

Yessir, a deal has been struck with RINOs and libtards that want to continue to see these poor Mooslims continue to flow into our country. A deal to help President Trump's nominees flow through the nomination process. Yes, the deal maker he is has not taken steps that could have been done to revoke this order overnight and protected our shores against these 7 countries. Yes, a deal had been cut, you can beat your eye teeth on it.

The thing is President Trump could have sent this packing a day later at the appeals court. There was evidence of 20+ crimes where refugees from these 7 countries were ARRESTED and President Trump's appeal did not present it until later this WEEK. All of this smells FISHY.

and all the while the American People that President Trump vowed to protect go unprotected on our Southern borders and at every Airport and US Consulate Office because he will not finish the deal and take this judge to the ground. He has the legal standing and he knows it but will not or does not WANT to interfere with a deal that has been cut.
They do own it and based on one of the idiot three’s subsequent acts has asked the en banc review by the 9th. This tell me one of two things is at play.
First, it has dawned on them that they own it, lock, stock and barrel. An attack will happen and then the whole blame game goes to them.
Second, Knowing they ruled on anything other than the constitutionality of the order, are looking for reinforcement or the en banc to bail them out because of the first. Maybe even someone else on the 9th is pressuring them to ask for the review because they are getting hammered, even in places tat would normally be with them.
Either way, it will get over ruled either by the 9th en banc or SCOTUS because they never addressed their prime charge, the constitutionality.
Why hasn’t the Secretary of State taken control and slowed this down? This is more than the 9th Circuit. The State Department is rushing in enemy aliens even though they are nominally part of the Trump government.
Simplest solution for EO: “ALL IMMIGRATION IS HALTED INDEFINITELY. NO EXCEPTIONS.”
The more words you write, the more likely that some ambulance chaser will find a way to attack it.

That’s what the EO was supposed to do. But now the judges are calling the shots.
9th circuit hearings were all done before Sessions was sworn in.
This is more than the blocked EO. The State Department could do what bureaucracies do so well, move slowly. Instead they have sped up and are racing in the invaders even faster. The State Department is not even working for the US government.
The TRO constitutes a judicial usurpation of congressional and executive branch powers. You are correct in that the 9th Circuit knows it screwed up, and hopes to somehow wriggle its way out of the mess it created.
But, will a gaggle of social justice warrior judges reverse its three-judge panel and embarrass themselves to the delight of DJT and most of the country? I won’t count on it.
If the en banc panel upholds the TRO, Trump should implement it anyway. He has the Constitution, the law, and the people on his side. Rub judicial noses into the sh!t they made.
This EO may be too little too late I fear. The terrorists are already here I fear.
