Disheartening and demoralizing, wailed Judge Neil Gorsuch of President Trumps comments about the judges seeking to overturn his 90-day ban on travel to the U.S. from the Greater Middle East war zones.
What a wimp. Did our future justice break down crying like Sen. Chuck Schumer? Sorry, this is not Antonin Scalia. And just what horrible thing had our president said?
A so-called judge blocked the travel ban, said Trump. And the arguments in court, where 9th Circuit appellate judges were hearing the governments appeal, were disgraceful. A bad student in high school would have understood the arguments better.
Did the president disparage a couple of judges? Yep.

The 9th circus will be broken up. Trump will let this ride for now. Even diehard democrats see the injustice done here by the 9th. No one can question the president on a border issue. The is clearly one of the many duties he has. The 9th circus just told us that our president is ceremonial. The people will get behind Trump on this.
If a terrorist gains entry as a result of these judges decision, and citizens are killed as a result thereof, some how, some way, these judges should pay a price.
I am not a lawyer so I don’t know what remedies are available. It just doesn’t make sense to gamble with people’s lives.
Trump’s DoS is not obummer’s DoS
This ongoing melodrama is a timely reminder of two things:
It’s not just the activist judges on the Supreme Court and the Circuit Courts who have been instrumental in destroying the country through bias or deciding to legislate from the bench.
Many lower court judges have played a big part (and still do).
Too many times seemingly staunch conservatives who are appointed to judgeships at all levels turn out to be wishy-washy liberals or hard core leftists.
But this is especially troublesome at the higher level courts.
Look at Chief Justice Roberts as a glaring recent example.
Is it the position and case load that cause them to alter their views from conservative to liberal or are other factors at work?
Liberal appointees don’t seem to become more conservative so what is behind these phenomena?

What the hell is wrong with “disparaging judges”?
Especially if they deserve it.
It's because the current nature of government is to do nothing, to get nothing done, and to slowly squeeze the life out of the electorate. Trump worked extremely hard to gain his position, but it's only 1 out of 3, with the other 2 colluding together to stymie all reform.
I hope Trump is as bright as he claims & I've been lead to believe. If he is, he'll have to stage a tactical retreat, regroup and figure out a 2 year plan to re-shape Congress. He must have them commit to ending their alliance with the judiciary. He'd going to have to get back out on the campaign trail and fight against those not with the program.
In essence, without congressional support he's already a lame duck. It doesn't matter what's in the constitution or what laws have been passed by Congress. The courts can merely interpret anything as they wish, Congress will remain silent, and if Trump chooses to ignore, they can then impeach.
As I've said before, the eternal issue is state vs individual. The state has been gaining power for 100 years. It was naive to assume it could be reversed with just a presidential election.
Legal education is the problem.
There’s no group of law schools from which to draw conservative judges. Originalism is history and philosophy now. It’s use in modern legal theory would dead-end the user’s career.
I predict Gorsuch will be Souter 2.0.
Congress needs to pass a law depriving the courts below SCOTUS of jurisdiction over cases involving aliens seeking visas. The courts don’t have such jurisdiction, but they are claiming to. Divest them of it. The Constitution expressly allows Congress to control what types of cases courts can hear.
Note to world: the judiciary has no such prerogative. Their only power is simply claiming they have priority. But they need a powerful ally to take that position, and in that they have everyone trumped: they have the fully backing of Congress.
In essence, Congress can do anything they want. That's how not only the constitution, but parliament is constructed. The peoples' representatives run the country, and if they want to allow the courts to legislate from the bench, then they have that right.
So the issue isn't the judiciary, but Congress. The composition of Congress must be altered to the point where they will cut their alliance with the courts, and side with the executive.
I have absolutely no doubt that this will (eventually) occur. The only real issue is timing. Trump needs to avoid being placed in a position where they can impeach, and work to prepare his offensive. Consider it took 2 years between Midway and D-Day. That's the kind of time-frame Trump should be looking at.
Stage a tactical retreat now. Anything and everything he does is going to be blocked. It doesn't matter if he reads the actual code or cites the constitution. The courts can rule however they want with no restraint - as long as Congress backs them up.
Congress is the prize, not the presidency.
Agreed - The judiciary isn’t vested with power in the sense that the executive of legislature is.
But judges have gradually assumed power from the legislature and the legislature has acquiesced. In effect the courts have granted themselves extra-constitutional powers and the legislature has allowed it.
The legislature is generally lazy and cowardly and always political. And for various reasons often relinquishes its constitutional authority to one or both of the other branches.
look how they quietly stood by most of the time as Barack Obama usurped their powers and legislated from the White House for most of the last eight years.
Congress and the Senate could act right now to back the President and put the relationship of the three branches back in proper balance - but they won’t.

I said in the campaign all Congress had to do was freeze Trump out for 2 years and then he would be done. I hope that does not happen, but I realized the Swamp is pretty deep. I think he is the only one up to the job of taking them on.
That episode with Gorsuch makes me skeptical about him on the Bench. He sounds now like a judge who will “grow in office.”
First of all, who knows what the Judge really said? When a dems lips are moving they are usually lying.
I find it heart breaking and demoralizing that Judges commit sedition by totally ignoring the law, and overstepping their authority.
Our civilization is truly in trouble when judges have so little regard for the law and the constitution they are supposed to uphold.

Yep. Very naive. His appointees are the very thin skin on stop if the filthy swamp water. And some of those he appointed are his former opponents. And Roger Stone indicated he doesn’t trust them.

Oh he did that for years and years. OTOH....so what; Rush hasn’t been any good since the “TOE FUNGUS” days.
Exactly, who the hell are they going to send? US Marshals? Who? I’m unaware of any enforcement arm of the 9th Circuit court. You know, the folks that tend to carry guns.
In addition, as someone stated earlier, direct Tillerson to close ALL embassies, to anyone, other than US citizens traveling abroad and needing help in some way.
