They could send it back to Robart as he did not really make a rule on the law. He just expressed his feelings. However I expect the ruling to come down 2-1 in upholding Robart’s ruling.
That 2 to 1 against was my take yesterday, allowing for a 3 to 0 against, or 2 to 1 for variance. No way we get 3/0 for us.
