Appeals Court Denies Justice Department's Motion to Lift Travel Ban Restraining Order By DEAN SCHABNER DAVID CAPLAN Feb 5, 2017 The U.S. Court of Appeals for the 9th Circuit announced early Sunday morning that it has denied the Department of Justice's emergency motion -- filed late Saturday -- to issue an immediate stay on a Washington State judge's temporary restraining order of President Donald Trump's controversial travel ban.
"The court has received appellants' emergency motion (Docket Entry No. 14)," read the order from the appeals court. "Appellants' request for an immediate administrative stay pending full consideration of the emergency motion for a stay pending appeal is denied."
Lawyers from Washington State and Minnesota, who brought the challenge to court in Seattle, have until Sunday at 11:59 p.m. Pacific Time to file a response to the Department of Justice's request. The Justice Department then has until Monday 3 p.m. Pacific Time to file a reply brief.
Lawyers for the Department of Justice argued in the filing that the restraining order is "vastly overboard," and it "second-guesses" the commander in chief.

All this means is they want to hear both sides first. I don’t think it’s the right decision, but it’s not a loss.

Are you at all familiar with the 9th circuit court? It’s a loss.
Might have to wait until Trump’s SC nominee is seated before appealing to the SC. As long as there are 4 liberal Dems on the SC it does not take a rocket scientist to count the 4 votes in the can against the executive order and since it will take 5 votes to overturn the lower court decision and there are only 4 prospective votes to overturn, my math says to wait until Gorsuch is seated.

Trump lost as soon as he played the appeal game. it as obvious. Pick a Bush appointee from the 9th circus knowing the was SC was 4-4 at best. Trumps only play was to ignore the ruling and call out the Judges overreach. The EO was a botch from the beginning. NO SOS, NO AG, issued while people we are sitting in airplanes en route. I’ts just a mess. Now if they aren’t careful the 9th is going to set a precedent that could haunt the country for god knows how long. Easy for me to say but that’s how I see it.

President Trump should write another EO that says that anyone entering the country from those seven countries will be detained until they can be vetted properly.
The judges are corrupt in a general sense because they support the status quo of those who hate Trump in the political and business “establishment” plus the Ninth Circuit has left-wing people on it who would be glad to overrule Trump in a heartbeat.
