Opening Statement On Friday, a Boston federal judge issued a 21 page decision debunking the arguments against Trump’s Executive Order suspending migration from certain countries pending further review. Later that same day, a Seattle federal judge who has been making the news lately (and not usually for the most flattering of reasons), declared his oral intention to sign an order limiting some aspects of the executive order. In the courtroom, whose position is likely to ultimately win?

The ruling of this judge is a joke. He basically says that there is no risk of a terrorist attack but the travel restrictions may cause irreparable harm to migrants. He is insane. This ruling won’t stand for very long.

There is no legal leg to stand on. The law is the law. They can only argue that everyone has been looking the other way- they can also bribe and manipulate.

Creeping judicial interference.

I don’t know which way Trump should go on this, ignore it or take to to court.

Ordinarily I would take it to court and actually bring it right to the SCOTUS for immediate review. The lesser courts will just be a public relations campaign for the anti-trump crowd.

But today, I feel the court needs to be slapped down for wandering into the political arena. The strongest play is Trump just ignoring the court. Challenging them in the political arena that they jumped into.

Sure, they’ll find and shop judges along the way, but I think there are enough conservative judges that know the court shouldn’t be questioning the Executive power over immigration and entry/exit into the country.

Boston used to be known as the birthplace of freedom.

now, just another liberal cesspool catering to the dregs of socialism.

Effing state legislators just ignored their own state constitution to vote themselves a $40,000 pay raise.

And this is mere months after their constitutionally mandated pay increase at year end.

The Boston judge sided with Trump. But the Seattle judge is a known Black Lives Matter supporter looking for 15 minutes of fame.

The Supreme Court is 4 Leftists: Ginsburg, Breyer, Sotomayor and Kagan plus 2 who support the Constitution: Thomas and Alito. It has one in the middle who generaly votes with Thomas and Alito but there is no guarantee and then there is Obamacare advocate Chief Justice Roberts. Roberts also generally votes with Alito and Thomas. Generally.

This is at best a 4-4 tie and it will remain so while we wait and wait and wait for Congress to approve Gorsuch.

Assuming this gets to the Supreme Court "quickly" the tie would mean that the previous court ruling would stand. That means Trump loses unless the 9th Circuit Court reverses the Washington ruling. The 9th Circuit is not particularly friendly to our side. Not by a long shot.

Hopefully Trump has a plan.

Not if they get another leftist judge. Our judiciary just doesn’t care and makes up their own laws! Even when they are written in such straightforward language! There need to be repurcussions for these judges.

The migrants have no Constitutional rights.

The authority for the President to put restrictions on immigration is in the Constitution. Not a complex case at all.

The Federal workers should defy the judge’s order and continue to follow Trump’s Executive order. He will then pardon anybody who is brought up on any charges.

I haven't been in a car accident for +40 years of driving. Does the same logic applied mean I can legally not follow the seat belt laws?

This is very deliberate. That’s the problem with a 4/4 court. A tie will uphold the lower court.

For years and years I have been told that ‘Ignorance of the Law is no excuse’. I suppose that’s fine as long as that principle is applied equally and impartially. With that being said, I think the following should be also said:

A judge should not have immunity from making bad decisions. Especially in cases like this one. If the order he issues causes death destruction from the people he is insisting have the right to come in to the United States. Then he should be, no... make that MUST BE indicted as a an accomplice or at the least a co-conspirator.

They, the judges, MUST be held accountable for their bad decisions. And I don’t mean impeachment I mean being put into the same judicial system that they have run roughshod over for much of the time the United States has been a country. They are not above the law, although in practicality they are. They are not a ‘superior caste’, they are fellow Americans and as such we live in a country guided if not ruled by law and the law applies to them also.

Chief Justice Roberts should decline to fast track this order and send it to the full circuit court for a full review.

Gorsuch will not be seated until April 15th at the earliest.

The Seattle order is an absolute joke. The judge concluded that the plaintiffs are likely to succeed on the merits but offers no law or no application of the facts to support this conclusion. Nothing. It’s nothing but a “because I said so” order.

But there are two opposing rulings in the lower courts. So which one controls? I would ignore the one and cite the other.
