BuzzFeed Could Be In Legal Trouble For Publishing Trump Doc

While BuzzFeed weathers criticism for publishing a document cache containing unsubstantiated and scandalous allegations about President-elect Donald Trump and his confidantes, they also could face legal consequences.

The organization elected to publish a 35-page dossier claiming Russian operatives had compromising personal and financial information about the president-elect and others in his orbit. The documents were compiled by a former British intelligence officer working for a private intelligence firm in London at the behest of Trump’s political opponents. They were later shared with Democratic political operatives and members of Congress.

“Whether a local jury (BuzzFeed’s headquarters is in NYC) could be found that would give Trump a fair trial is another matter.”

The person who files a lawsuit gets to pick the jurisdiction that will hear the case (which is why you always want to be the first to file for divorce if it is inevitable). Their libel was published worldwide via the internet, so the victims can claim they were harmed in just about any venue on the planet.

Right in the article they volunteer four or five versions of “we just don’t know if this is true”. Whether that is “reckless” disregard for the truth is for the judge to decide I guess.

When other big fake news has come out in the past, e.g. Bush National Guard, Rolling Stone rape hoax, the organization at least pretends that it thinks it’s true.

I don’t think they’re the same kind of case. The Hogan / Gawker case was more of privacy. Hogan didn’t make the case that they were just making stuff up, or publishing stuff (his sex tape) that they didn’t try to verify.
